A BILL FOR AN ACT
relating to solar energy.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 481B-6, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) No person shall advertise, offer to sell, or sell a solar energy device unless the person clearly discloses separately the following information concerning the sale price of the solar energy device to the consumer:
(1) The cost of the solar energy device and
accessories related to the operation of the solar energy device and for their
installation; [and]
(2) The cost of items unrelated to the operation of
the solar energy device, including but not limited to, "free gifts",
offers to pay electric bills, rebates, and other incentives designed to promote
the sale of the solar device[.];
(3) Any extra costs for the installation of the solar energy device, such as the costs of any connection studies to be conducted by an electric utility; and
(4) The possibility that the electric utility may exercise its right under section 269-108 to refuse to purchase from the consumer any excess kilowatt-hours generated by the consumer through the consumer's operation of the solar energy device."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
