A BILL FOR AN ACT

 

 

relating to culture and the arts.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  Section 103-8.5, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The works of art special fund shall be used solely for the following purposes:

     (1)  Costs related to the acquisition of works of art, including any consultant or staff services required to carry out the art in public places and relocatable works of art programs;

     (2)  Site modifications, display, and interpretive work necessary for the exhibition of works of art;

     (3)  Upkeep services, including maintenance, repair, and restoration of works of art; and

     (4)  Storing and transporting works of art[.];

provided that from July 1, 2014, through June 30, 2016, any unencumbered moneys in or transferred into the works of art special fund shall be expended by the comptroller, in consultation with the state foundation on culture and the arts, for the purpose of improving and upgrading systems used to monitor and secure the inventory of acquired works of art; provided further that any funds unencumbered and unexpended after June 30, 2016, may be used for the purposes described in paragraphs (1) to (4)."

PART II

     SECTION 2.  The auditor shall conduct a financial and management audit of the state foundation on culture and the arts that shall include but not be limited to determining:

     (1)  The total annual expenditures incurred for the acquisition of works of art;

     (2)  Costs associated with site modifications, display, and interpretive work for the exhibition of works of art;

     (3)  Costs associated with upkeep services, including maintenance, repair, and restoration of works of art;

     (4)  The methodology used for obtaining works of art;

     (5)  The current inventory of acquired works of art under the control of and maintained by the state foundation on culture and the arts; and

     (6)  The methodology and systems currently used to monitor and secure the inventory of acquired works of art.

     SECTION 3.  The auditor shall submit a report of the auditor's findings and any recommendations regarding the financial and management audit of the state foundation on culture and the arts, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2015.

PART II

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2014; provided that on July 1, 2016, this Act shall be repealed and subsection 103-8.5(b), Hawaii Revised Statutes, shall be reenacted in the form in which it read on June 30, 2014.

Report Title:

Culture and the Arts; Works of Art Special Fund

 

Description:

Requires that for a two-year period, any moneys currently in or transferred into the Works of Art Special Fund be used solely for improving and upgrading systems used to monitor and secure the inventory of works of art acquired by the State.  Requires the Auditor to conduct a financial and management audit of the State Foundation on Culture and the Arts.  Effective July 1, 2014.  Repeals on July 1, 2016.
