A BILL FOR AN ACT
relating to ceded lands.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that there has never been an accurate inventory of ceded lands in Hawaii.
Although there is a tax map key system that identifies parcels of property in Hawaii, it does not differentiate between ceded and non-ceded lands. The current methods used to categorize ceded and non-ceded lands may result in the loss of substantial revenues that are due to the office of Hawaiian affairs. According to section 10-13.5, Hawaii Revised Statutes, "twenty per cent of all funds derived from the public land trust", also known as ceded lands, shall be expended by the office of Hawaiian affairs for the betterment of conditions for native Hawaiians, among other responsibilities.
The purpose of this Act is to require the department of land and natural resources to conduct an audit of all state-held lands and an inventory of ceded lands and report to the legislature prior to the convening of the regular session of 2014.
SECTION 2. The department of land and natural resources shall conduct an audit of all state-held lands. The audit shall include, at minimum:
(1) The parcel size;
(2) The parcel location;
(3) The state land use district;
(4) The tax map key;
(5) The state agency holding title; and
(6) The trust land status.
SECTION 3. The department of land and natural resources shall develop an inventory of ceded lands in the State, including the location and size of each parcel.
SECTION 4. The department of land and natural resources shall submit a report to the legislature, including the state land audit and inventory of ceded lands, no later than twenty days prior to the convening of the regular session of 2014.
SECTION 5. This Act shall take effect upon its approval.
