RELATING TO LONG TERM CARE. Requires the Director of the Executive Office on Aging to contract for the performance of a feasibility study and an actuarial analysis for a limited, mandatory, public long term care insurance program for the State's working population. Appropriates funds. Effective 7/1/2030. (SD2)

RELATING TO PRESCRIPTION DRUGS. Allows beneficiaries of prescription drug benefit plans to opt out of the requirement to purchase prescription drugs from a mail order pharmacy and, as an alternative, choose to purchase prescription drugs from a pharmacy within the pharmacy benefit manager's retail pharmacy network. Prohibits a pharmacy benefit manager from restricting a beneficiary's choice of pharmacy from which to purchase prescription drugs if the pharmacy is within the network. Requires affected entities to report to the legislature prior to the regular session of 2018. Repeals 06/30/2018. Effective 07/01/2050. (SD2)

RELATING TO GOVERNMENT. Requires annual reports from the Native Hawaiian Roll Commission. Amends the definition of "qualified Native Hawaiian" to include individuals who meet certain expanded ancestry requirements. Establishes that the Native Hawaiian roll commission is responsible for including in the roll all individuals already registered as Hawaiians or Native Hawaiians through the office of Hawaiian affairs. Repeals directive to amend the Hawaiian Homes Commission Act. Effective July 1, 2050 (part I). Promotes renewable energy in Hawaii by: (1) providing that all penalties, fees, and costs established and collected by the Department of Land and Natural Resources pursuant to Chapter 182, Hawaii Revised Statutes, be deposited in the Special Land and Development Fund; (2) including geothermal resources within the definition of a renewable energy producer; and (3) clarifying the permitting procedures for regulators and renewable energy developers considering geothermal development. Requires the use of an area or site within the conservation district for geothermal resources development to be governed by the board of land and natural resources. Authorizes certain county authorities to issue geothermal resource permits to allow geothermal resources development in an agricultural, rural, or urban district if the development is not considered a permissible use under the applicable county zoning ordinances or general plan. Repeals definition of and deletes references to "reserved lands" in chapter 182, Hawaii Revised Statutes. Effective July 1, 2050 (part II). (SD2).

RELATING TO HEALTH. Requires certain private employers to allow employees to take paid leaves of absence for organ, bone marrow, or peripheral blood stem cell donation. Requires employers to restore an employee returning from leave to the same or equivalent position. Establishes a private right of action for employees seeking enforcement of provisions. RELATING TO BUREAU OF CONVEYANCES. Separates voluntary deregistration of fee non-time share interests from the deregistration provisions under part II of chapter 501, Hawaii Revised Statutes. Repeals the sunset provision of section 2 in Act 120, Session Laws of Hawaii 2009, relating to deregistering land. Sunsets voluntary deregistration of fee non-timeshare interests provisions on 12/31/14. (SD1)

RELATING TO REMOTE DISPENSING. Prohibits new remote dispensing pharmacies from operating within ten miles of any pharmacy, excepting those remote dispensing pharmacies in operation prior to the effective date of this measure. Extends the repeal date of Act 212, Session Laws of Hawaii 2008, to January 1, 2016. (SD2)

RELATING TO HEALTH. Prohibits the sale of tobacco or electronic smoking devices to minors under eighteen years of age and the purchase of tobacco product or electronic smoking devices by minors under eighteen years of age. Requires retailers to sell tobacco only in a direct face-to-face exchange between the retailer and consumer. Permits exceptions for retail tobacco stores, bars, or establishments where the minimum age for admission is eighteen. (SD2)

RELATING TO THE STATE BUILDING CODE. Modifies the composition and quorum of the Hawaii State Building Code Council and revises the State Building Code. Provides funding for the State Building Code Council for activities that are a part of a loss reduction plan. Makes an appropriation. Takes effect on 01/01/2050. (SD1)

Updates the Insurance Code by streamlining and improving the operations of the Insurance Division of the Department of Commerce and Consumer Affairs and ensuring that the Insurance Division retains its accreditation with the National Association of Insurance Commissioners. RELATING TO THE HAWAII HEALTH SYSTEMS CORPORATION. Makes the five regional chief executive officers on the Hawaii Health Systems Corporation (HHSC) Board, ex-officio, nonvoting members. RELATING TO FAMILY COURT. Clarifies the appointment requirements and qualifications for child custody evaluators. Requires the Judiciary to establish a referral process regarding a child custody evaluator appointed by the court. Effective 07/01/2050. (SD2)

RELATING TO CONTRACTS. Exempts an owner's agreement with an attorney to file a claim as to identified property or contest the administrator's denial of a claim from the application of section 523A-25, Hawaii Revised Statutes; provided that an owner's agreement with an attorney that provides for compensation shall not exceed twenty-five per cent of the total value of the property. Provides an exception to the twenty-five per cent limit for an owner's agreement with an attorney to maintain an action in circuit court upon approval of the court. (SD2)

RELATING TO HUMAN TRAFFICKING. Designates January as Human Trafficking Awareness Month. Amends the definitions of "child abuse or neglect" and "harm" under sections 350-1 and 587A-4, Hawaii Revised Statutes, respectively, to extend certain services and duties of the Department of Human Services to victims of labor trafficking.
