RELATING TO ANIMAL CRUELTY.

Requires dogs or cats that are captured or killed in a snare or trap to be reported to a county animal control officer.  Establishes an animal cruelty offense for the use of steel-jawed leg-hold traps, and the use of snares, conibear, and foot- or leg-hold traps in residential or other prohibited areas; provides exemptions for activities carried out by state and federal agencies; establishes the offense as a misdemeanor. RELATING TO VETERINARY MEDICINE.

Prohibits the owner of a pet animal and the owner's employees from performing any surgical procedure, including but not limited to surgical birth, ear cropping, tail docking, dewclaw removal, and debarking on the pet animal without being licensed as a veterinarian.  Makes intentionally or knowingly performing any surgical procedure, including but not limited to surgical birth, ear cropping, tail docking, dewclaw removal, and debarking, on a pet animal by any person not licensed as a veterinarian a class C felony.  Specifies that accepted veterinary practices and cropping or docking as customarily practiced, shall not be considered cruelty to animals in the first degree if performed by a veterinarian licensed under chapter 471, HRS.  (SD1)

Changes existing gasoline requirement of ten per cent ethanol fuel content to a requirement that each distributor who sells liquid fuels in the State for use in motor vehicles shall ensure that locally-produced biofuels account for at least five per cent of the distributor's annual sales of liquid fuels for motor vehicles by volume; provided that for diesel fuel, no more than five per cent of locally-produced biofuel shall be required.  Effective 07/01/2050.  (SD2)

Requires county police departments to fingerprint, photograph, and perform background checks on individuals who wish to register a firearm that was procured out-of-state.  Authorizes the police departments to assess a fee for conducting a fingerprint check and specifies the amount of the fee.  Extends the time period for registering a firearm procured out-of-state, for consistency with the time period for registering firearms obtained in or imported into the State.  Appropriates funds for county implementation.  Effective 07/01/2050.  (SD2)

Clarifies the power of the Hawaii public housing authority to sell, lease, rent, hold, maintain, use, and operate certain properties.  Authorizes the authority to receive all gifts provided they benefit public housing residents.  Requires that the acceptance of gifts with an estimated value of $1,000 or more be approved or confirmed by the board.  Authorizes the authority to use volunteer services.  Exempts the authority from various state laws for the use of volunteer services.  Effective 07/01/2050.  (SD1)

Amends criteria to be used by the auditor in analyzing legislative bills proposing to establish new special or revolving funds.  Clarifies that a special or revolving fund to be established or continued shall reflect a clear nexus between benefits sought and charges made upon program users or beneficiaries or between the program and the sources of revenue.  Requires the auditor to review special funds, as well as revolving and trust funds, of designated governmental entities.  Beginning 2014 and every five years thereafter, requires the auditor to review the special, revolving, and trust funds of the DOT and DOD.  (SD1)

RELATING TO PROSTITUTION.

Makes solicitation of a minor for prostitution a crime.  Increases the statute of limitations to bring a cause of action for coercion into prostitution from two to six years.  Clarifies the minimum and maximum fine for a person convicted of committing the offense of prostitution.  Adds the offenses of solicitation of a minor for prostitution, habitual solicitation of prostitution, and solicitation of prostitution near schools and public parks under the State's forfeiture laws.  Amends the definition of "sexual offense" under the sexual offender registry laws to include acts that consist of the solicitation of a minor who is less than eighteen years of age for prostitution.

Moves the framework for establishing an annual conference of secondary school students from chapter 317, HRS, to chapter 302A, HRS.  Removes the governor's authority to appoint members of the student conference committee.  Authorizes the superintendent or the superintendent's designee to select the public school members of the student conference committee.  Authorizes a representative of the Hawaii Association of Independent Schools to select the members of the student conference committee from schools represented by the Hawaii Association of Independent Schools.  Clarifies that the student conference advisory committee will provide guidance to the student conference committee in carrying out its purpose and duties.  Repeals the mandatory legislator and department of education membership and instead clarifies that the department of education shall maintain guidelines and procedures for selecting the student conference advisory committee.  Clarifies that the annual student conference is subject to program and funding limitations and removes the three day limit.  Repeals the requirement for an evaluation report on student conference proceedings.  Repeals chapter 317, HRS.  (SD1)

Amends section 302A-854, HRS, to require the department of health, in consultation with the University of Hawaii school of nursing and dental hygiene, to provide training and clinical direction to school health aides until June 30, 2014.  Repeals section 302A‑708, HRS, which requires the department of education to provide career pathways development and training opportunities to school health aides in the department's school health services field.  Requires the department of education and department of health to enter into a memorandum of understanding relating to the training of school health aides and submit a copy to the legislature no later than twenty days prior to the convening of the regular session of 2014.  Effective 7/1/2050.  (SD2)

Permits charter schools to carry over a percentage of unexpended appropriations to the next fiscal year.  Requires charter schools to complete an annual independent financial audit.  Requires the state public charter school commission (commission) to develop procedures for conducting criminal history checks of persons who are employed or seeking employment in any position that places them in close proximity to children.  Specifies enrollment requirements.  Authorizes the commission to make facilities funding requests to the director of finance.  Requires the commission to determine criteria for distribution of facilities funding.  Specifies when an employer or potential employer may use criminal history information to terminate or deny employment.  Requires commission members to disclose to the commission a list of all charter schools in which the member is an employee, governing board member, vendor, contractor, agent, or representative and disqualifies members from voting on or participating in the discussion of such matters.  Authorizes the commission to hire employees without regard to chapters 76 and 89, HRS.  Removes the requirement that a nonprofit organization that governs a conversion charter school make minimum annual contributions to the charter school.  Makes other amendments to chapter 302D, HRS, for purposes of clarity and consistency.  Effective 7/1/2050.  (SD2)

RELATING TO MEDIATION AFFECTING JUDICIAL FORECLOSURE.

Expands the application of mandatory mortgage foreclosure dispute resolution by requiring mortgagees, at the mortgagor's election, to participate in mediation to avoid foreclosure or mitigate damages from foreclosure prior to filing a judicial foreclosure action for property that has been the mortgagor's primary residence for a specified period.  Applies the dispute resolution requirement to judicial foreclosure actions filed prior to the effective date of this bill and pending an initial court hearing.  Exempts the dispute resolution requirement to judicial foreclosure actions if the mortgagee engages in loss mitigation procedures with the mortgagor.  Establishes notification requirements for a mortgagee to notify a mortgagor with respect to loss mitigation options.  Requires that an attorney affirm that a mortgagee engaged in loss mitigation procedures with the mortgagor when filing for a judicial foreclosure action.  Effective 07/01/50.  (SD2)

RELATING TO THE UNIVERSITY OF HAWAII.

Charges the Board of Regents with oversight of the University General Counsel.  Exempts the Board of Regents, and repeals UH's exemption, from the prohibition to contract with attorneys.  Requires the Auditor to review legal contracts entered into by UH.  Effective 07/01/50.  (SD2)

RELATING TO THE UNIVERSITY OF HAWAII.

Requires the UH board of regents to undergo annual training on board policies and procedures, Hawaii's sunshine law, Hawaii's open records law, and Hawaii's ethics standards.  Requires each regent to receive certification that the regent successfully completed the training.  Provides that the certification may include passing a test on the training's subject matter.  Requires the removal of a regent from the Board if the regent does not meet the annual training requirements more than once during the regent's term.  Requires the Board chair- and vice-chairpersons to be elected by sitting, not outgoing, regents.  Effective 7/1/50.  (SD1)

RELATING TO THE REGENTS CANDIDATE ADVISORY COUNCIL.

Amends section 304A-104.5, HRS, to give the governor the authority to reject candidates to the board of regents of the University of Hawaii presented by the regents candidate advisory council and require the regents candidate advisory council to present new candidates within sixty days.  Specifies that each member of the regents candidate advisory council shall serve for the duration of the term of the member's appointing authority, up to a maximum of four years per term.  Effective 07/01/2050.  (SD2)

RELATING TO THE RESEARCH CORPORATION OF THE UNIVERSITY OF HAWAII.

Reduces the membership of the board of directors of the UH research corporation from 10 to 8 members.  Reduces the number of members of the board of regents who must be members of the board of directors from 5 to 2.  Specifies the qualifications of the 5 members to be selected by the governor.  Adds the UH vice president for research as an ex officio member of the board of directors.  Provides that the research corporation's exemption from the procurement requirements shall not apply to certain construction contracts.  Removes the university president's authority to serve as the president of the research corporation.  Authorizes the board of directors to employ an executive director of the research corporation.  Caps the executive director's salary at twice the salary of the highest paid head of a department within the executive branch.  Effective 7/1/2050.  (SD2)

RELATING TO THE STATEWIDE TRAFFIC CODE.

Adds civil defense, state law enforcement, and county emergency management vehicles to the definition of "emergency vehicle" under the move over law.  Adds a charge of manslaughter as a possible offense when a driver does not move over and kills an emergency responder.  (HB1308 HD1)
