RELATING TO MENTAL HEALTH.

Adds definition of "law enforcement officer".  Amends references from "police officer" to "law enforcement officer" in the Hawaii Revised Statutes sections relating to emergency admission and involuntary hospitalization.  Authorizes advanced practice registered nurses to assess whether there is probable cause to believe a person is mentally ill or suffering from substance abuse or is otherwise in need of care, treatment, or both.  (SD1)

RELATING TO THE DEPARTMENT OF EDUCATION.

Removes a representative from the department of education from the membership of the aerospace advisory committee.  Amends section 205A-62, HRS, to remove the department of education from the list of state agencies with responsibilities relating to marine and coastal zone management.

RELATING TO AGING.

Allows the policy advisory board for elder affairs to recommend to the governor to honor non ex officio members by lifetime membership, which includes all the rights and privileges of a non ex officio member, upon approval by all regular members of the board.  (SD1)

RELATING TO ADVANCED PRACTICE REGISTERED NURSES.

Amends section 457-8.5(a), Hawaii Revised Statutes, by recognizing the National Council of State Boards of Nursing's advanced practice registered nurse consensus model and clarifies language relating to advanced practice registered nurse educational requirements consistent with that consensus model.

RELATING TO MEDICAID.

Extends the termination date of the Medicaid buy-in task force to 6/30/2014.  Requires submission of an interim and final report.  Takes effect 6/29/2013.  (SD1)

RELATING TO THRILL CRAFT.

Allows thrill craft to be used to conduct ocean cleanup activities.  Requires the department of land and natural resources to adopt rules to implement such use of thrill craft.

RELATING TO ANIMALS.

Permits a landlord to hold a tenant's security deposit for the purpose of paying for damages caused by a pet animal residing in the premises.  Authorizes a landlord as a condition of a rental agreement to add to the security deposit an amount for a pet animal to reside in the premises; provided that no landlord shall require any additional security deposit amount for an assistance animal that is a reasonable accommodation for a tenant with a disability.  Effective for rental agreements entered into on or after 11/01/2013.  (SD1)

Requires premises licensed under chapter 281, Hawaii Revised Statutes, to have a sign posted on or about the premises, including but not limited to the women's restroom, that provides customers with a warning of the risks of birth defects and fetal alcohol spectrum disorders for women drinking alcohol during pregnancy.  Takes effect 01/01/2014.  (SD1)

RELATING TO POLICE DEPARTMENT REPORTS TO THE LEGISLATURE.

Amends the annual reporting dates for police department reports submitted to the legislature.  Changes reporting period to previous calendar year.  Requires descriptions of each incident of misconduct reported.

PROPOSING AN AMENDMENT TO ARTICLE VI, SECTION 3, OF THE HAWAII STATE CONSTITUTION TO INCREASE THE MANDATORY RETIREMENT AGE FOR STATE JUSTICES AND JUDGES.

Proposes a constitutional amendment to increase the mandatory retirement age for justices and judges from 70 to 80 years of age.

RELATING TO TIME SHARES.

Requires a time share plan's disclosure of the financial obligation of the purchaser to consist of:  (1) A statement that the purchaser is obligated to pay the initial price in the purchase agreement; and (2) A list or description of any additional charges.  Clarifies that a sales or acquisition agent is not required to provide any promotional device or instrument to a prospective purchaser prior to making a sales presentation.  (SD1)

Replaces the Comptroller with the Chief Information Officer as a member of the Enhanced 911 Board.

Creates a class C felony for any person who intentionally or knowingly refuses or fails to provide a required blood specimen, buccal swab sample, or print impression for forensic identification.  Effective 07/01/50.  (SD1)

RELATING TO PRODUCTION OF RECORDS.

Amends section 306D-4, HRS, to allow for the service of process issued by another state upon a Hawaii recipient and clarifies the following:  (1) that the service of process may be upon a person or business, but not a government agency; (2) that the process is for the production of records; (3) that the process must be based upon a pending criminal investigation or prosecution; and (4) that the person or business being served must have conducted business or engaged in transactions occurring at least in part in the issuing state.  Effective 07/01/50.  (SD1)
