Provides that the certification may include passing a test on the training's subject matter. Amends section 304A-1005, HRS, to: (1) Limit the board of regents to appointing only one university general counsel; (2) Require the board of regents to have direct oversight over the university counsel and prohibit the board of regents from delegating this responsibility to the president of the university; (3) Require the university general counsel to report directly to the board of regents; and (4) Allow the board of regents to contract with independent attorneys solely in cases where the university general counsel and attorney general each acknowledge a lack of sufficient expertise. Establishes trust fiduciary duties, prohibits certain transactions, and establishes liabilities for breaching a fiduciary duty. Amends the membership, methods of appointment, and representation on the board of trustees; the selection process for filling a vacant trustee seat on the board; and the quorum requirements for voting by the board. Requires a time share plan's disclosure of the financial obligation of the purchaser to consist of: (1) A statement that the purchaser is obligated to pay the initial price in the purchase agreement; and (2) A list or description of any additional charges. Clarifies that a sales or acquisition agent is not required to provide any promotional device or instrument to a prospective purchaser prior to making a sales presentation.
