RELATING TO PUBLIC LANDS.

Provides several means of compensation in addition to rent reductions when the State withdraws, condemns, or takes public land leased for intensive agricultural or pastoral uses and renders the land unusable for the original purposes of the lease.

      Status & Testimony

RELATING TO APPRAISALS.

Requires valuation of public agricultural or aquacultural land to be based on the land's agricultural or aquacultural use, economic considerations, relevant risk factors, and societal benefits.  In the case of disinterested appraisals, requires that costs greater than one year's existing rent shall be borne by DLNR.

RELATING TO THE LEGACY LAND CONSERVATION PROGRAM.

Amends section 173A-2.6, HRS, to require the legacy land conservation commission to recommend agricultural lands, including arable areas and areas containing existing agricultural infrastructure, as the top priority for acquisition under the legacy land conservation program.

      Status & Testimony

RELATING TO GROUNDWATER RECHARGE.

Establishes an income tax credit for taxpayers who maintain permeable surfaces on their property.  Permits a taxpayer to deduct from state income taxes the costs of certifying an organic agricultural operation or determining a qualifying property's net water infiltration.

      Status & Testimony

RELATING TO RURAL AREAS.

Creates a state definition for a rural area for purposes of federal programs only so that certain areas that would not otherwise be considered rural pursuant to a federal definition will be eligible for federal funds designated for rural areas.
