RELATING TO TRANSPORTATION. Changes the State's automatic deduction of ten per cent of the gross proceeds of a county's surcharge on state tax to a deduction of a reasonable amount to reimburse the state for costs associated with handling the assessments, collection, and disposition of the county surcharge on state tax. Effective July 1, 2013. (HB364 HD1)

RELATING TO THE COUNTY SURCHARGE ON STATE TAX. Reduces the amount deducted from the county surcharge on state tax to reimburse the State for costs of assessment, collection, and disposition from 10% to 5%.

RELATING TO MOTOR VEHICLES. Requires motor vehicle insurers to electronically report to the insurance commissioner all existing policies within 45 days. Requires each insurer to report cancelled, nonrenewed, altered, and new policies.

RELATING TO NAMED OPERATOR EXCLUSION. Authorizes a named operator exclusion to enable a named insured to exclude specified persons from being covered under a motor vehicle insurance policy. Provides that a named insured that has rejected in writing the offer of uninsured motorist coverage under a motor vehicle insurance policy, or who has knowingly allowed the operation of a motor vehicle by a person excluded as a designated operator, shall not be entitled to the rights of claim and action against the assigned insurer, with reference to the mandatory bodily injury liability policy for accidental harm. Disqualifies the coverage to an excluded operator of a motor vehicle for an accident out of which the excluded operator's accidental harm arose.

RELATING TO MOTOR VEHICLE INSURANCE. Increases the minimum liability coverage from $20,000 to $50,000 per person and the aggregate limit from $40,000 to $100,000 per accident for motor vehicle insurance policies.

RELATING TO FUEL TAX REVENUES. Permits the county of Hawaii to appropriate the county's share of fuel tax revenue for the maintenance of substandard private subdivision roads that are used by the public. Provides that neither the State nor the county shall be required to install infrastructure improvements if the roads are thereafter sold to a private entity. Sunsets 6/30/18.

RELATING TO UTILITY FRANCHISES. Allows the State Department of Transportation Highways Division to collect an equitable compensation from franchise utility companies for the use of the state right of way.

RELATING TO HIGHWAY SAFETY. Creates a new law prohibiting the use of mobile electronic devices while operating a motor vehicle within the State of Hawaii. Establishes penalties.

RELATING TO MOTOR VEHICLES. Repeals the requirement for special inspection and certification of reconstructed vehicles prior to operation upon a public highway.

RELATING TO TRANSPORTATION. Clarifies the prohibition on the modification of the exhaust system of a motorcycle or moped that amplifies or increases the noise emitted by the muffler originally installed on the motorcycle or moped. Effective July 1, 2013.

RELATING TO MOPEDS. Requires annual registration and inspection of mopeds. Requires operators of mopeds to enroll in safety courses in order to operate their mopeds. Increases the fine for modifying a moped to $1,000.

RELATING TO SAFE ROUTES TO SCHOOL. Amends the fiscal year and appropriation amount for the safe routes to school program special fund. Provides that funds shall not lapse to the general fund. Effective July 1, 2013.

RELATING TO BICYCLES. Requires the department to identify, fund, and establish alternative bikeway projects when establishment of bikeways on new or reconstructed roads is not practicable. Requires report.

RELATING TO TRANSPORTATION. Requires the Department of Transportation to plan, design, and construct a shared-use pathway along the mauka side of Kahekili Highway. Requires start of construction no later than . Appropriates funds. Effective July 1, 2013.

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the legislative website after the hearing adjourns. This public posting of testimony on the website should be considered when including personal information in your testimony.
If during the course of the hearing it appears that there will not be sufficient time to allow everyone to be heard, the chairperson reserves the right to limit the remaining testifiers to three minutes. This three minute policy will be enforced to ensure fairness and adequate consideration to all bills.
