RELATING TO MENTAL HEALTH. Adds definition of "law enforcement officer". Amends references from "police officer" to "law enforcement officer" in the Hawaii Revised Statutes sections relating to emergency admission and involuntary hospitalization. Authorizes advanced practice registered nurses to assess whether there is probable cause to believe a person is mentally ill or suffering from substance abuse or is otherwise in need of care, treatment, or both. MAKING AN APPROPRIATION FOR PUBLIC SAFETY PROGRAMS. Makes appropriation to the department of public safety to contract with community-based non-profit organizations to provide education, mentoring, restorative circles, farming, artisan skills, cognitive behavioral therapy, and cultural healing services to inmates and former inmates who are under the custody and control of the department of public safety or the Hawaii paroling authority. Effective 07/01/2050. (SD2)

RELATING TO FIRE PROTECTION. Clarifies the authority of the county fire chiefs to examine building plans and documentation to ensure that they are in compliance with the fire code and fire and life safety standards. Requires the issuance of permits before work may begin. Effective 1/1/2050. (SD2)

RELATING TO POLICE DEPARTMENT REPORTS TO THE LEGISLATURE. Amends the annual reporting dates for police department reports submitted to the legislature. Changes reporting period to previous calendar year. Requires descriptions of each incident of misconduct reported.

RELATING TO SENTENCE OF IMPRISONMENT FOR SEXUAL ASSAULT OF A MINOR UNDER THE AGE OF TWELVE YEARS. Requires the court to impose a mandatory minimum term of imprisonment without possibility of parole or probation for a person convicted of certain acts of sexual assault against a minor under the age of twelve years. Effective 07/01/50. (SD1)

RELATING TO REGISTRATION OF COVERED OFFENDERS. Adds comparable foreign convictions and tribal convictions to covered offenses; makes offenders who are subject to sex offender registration or notification in their jurisdiction of conviction, covered offenders under Hawaii law; makes it clear that a covered offender must register and report the offender's permanent residence, current temporary residence, or if an address is not available, a description of the place or area in which the covered offender resides; amends the definition of "conviction" in section 846E-1, Hawaii Revised Statutes, to clarify that conviction, for purposes of sex offender registration, occurs on the date judgment is entered; creates a tier classification for any covered sexual offenses that are not clearly included within the current tier classification law; addresses the problem of covered offenders who do not have registered residences to which the post office can deliver mail and cannot receive the ninety-day verification mailings by requiring these offenders to report in person during the first weeks of the months of January, April, July, and October; and repeals the definitions of "mental abnormality, "personality disorder," and "predatory." Makes conforming amendments. Effective 07/01/50. (SD1)

RELATING TO INTAKE SERVICE CENTERS. Requires intake service centers to provide pretrial bail reports to the courts on adult offenders that are consented to by the defendant or that are ordered by the court and amends the law to provide statutory authority to the courts to treat information contained in the pretrial bail reports as confidential. Repeals the intake service centers' duty to provide pretrial assessments on adult offenders that are consented to by the defendant or ordered by the court and assist in the conduct of presentence assessments on adult offenders and the preparation of presentence reports when requested by the courts. DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
Submit testimony in ONE of the following ways:
PAPER: 3 copies (including an original) to Room 311 in the State Capitol;
FAX: For testimony less than 5 pages in length, transmit to 808-586-8529 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or
WEB: For testimony less than 10MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.
Testimony submitted will be placed on the legislative website after the hearing adjourns. This public posting of testimony on the website should be considered when including personal information in your testimony.
If during the course of the hearing it appears that there will not be sufficient time to allow everyone to be heard, the chairperson reserves the right to limit the remaining testifiers to three minutes. This three minute policy will be enforced to ensure fairness and adequate consideration to all bills.
