RELATING TO WAGES.

Requires employers to provide employees with specific wage and employer information at the time of hiring and in employees' pay records.  Increases civil and criminal penalties for employers' noncompliance with wage rate notice requirements.  Require public notice of employer violations.

RELATING TO PROFESSIONAL EMPLOYER ORGANIZATIONS.

Amends definitions and adds registration and fee requirements for professional employer organizations; repeals chapter 373L, Hawaii Revised Statutes; amends the definition of leased employees for enterprise zone coverage of a qualified business; amends the general excise tax exemption for professional employer organizations; allows professional employer organizations to apply for a transfer of a client company's experience record for unemployment insurance contribution purposes.

Requires the Hawaii labor relations board to resolve complaints within 90 days.

Increases maximum allowable medical fees under workers' compensation to 130% of the Medicare Resource Based Relative Value Scale.

Makes abusive conduct against a public employee a workplace safety and health violation.

RELATING TO PUBLIC EMPLOYEES.

Establishes the office of talent management within DHRD to design and facilitate state initiatives in the areas of talent administration, professional development, performance management, and leadership enterprise.  Authorizes the talent management administrator to receive from any state agency, such assistance, services, facilities, and data the administrator deems necessary to carry out the duties of the office.

RELATING TO WORKERS' COMPENSATION.

Requires that a workers' compensation impartial exam be conducted by a doctor whose specialty is appropriate for the injury to be examined.

RELATING TO WORKERS' COMPENSATION.

Requires independent medical examinations and permanent impairment rating examinations for workers' compensation claims to be performed by physicians mutually agreed upon by employers and employees or appointed by the director of DLNR.  Appropriates funds and positions for the DLNR disability compensation division to assist in workers' compensation claims.

RELATING TO FAMILY LEAVE.

Permits an employee to use family leave time to care for a sibling.  Defines "sibling".  Effective July 1, 2013.

RELATING TO HOURS OF WORK.

Allows state and county employees to request modified office hours.  Mandates that the chief executive bargain in good faith with the employees' exclusive representative.

RELATING TO THE OFFICE OF HAWAIIAN AFFAIRS.

Repeals eligibility for ERS, EUTF, and cafeteria plan benefits for officers and employees of the Office of Hawaiian Affairs who are paid in whole or in part by funds derived from the public land trust described in section 10-3, HRS.  States that all employees of the Office of Hawaiian Affairs shall be subject to chapter 92F, HRS.

Status

RELATING TO COLLECTIVE BARGAINING.

Prohibits:  (1) a public employer from wilfully implementing or attempting to implement any term of a collective bargaining proposal without the exclusive representative's agreement; and (2) a public employee or employee organization from wilfully implementing or attempting to implement any term of a collective bargaining proposal without the employee's agreement.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony should indicate:

·     Testifier's name with position/title and organization;

·     The Committee(s) to which the comments are directed;

·     The date and time of the hearing; and

·     Measure number. 

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
