RELATING TO EMERGENCY MANAGEMENT. Recodifies Hawaii's emergency management statutes by updating the statutes, clarifying the relationship between the state and county emergency management agencies, and delineating the emergency management functions and powers of the Governor and mayors. Effective July 1, 2050. (HB849 HD1)

RELATING TO DEFERRED ACCEPTANCE PLEAS. Prohibits the use of deferred acceptance of guilty pleas or deferred acceptance of nolo contendere pleas by defendants charged with an offense involving the killing of another person. Clarifies the prohibition of deferred acceptance pleas by defendants charged with a violation of a protective order.

RELATING TO LEAF BLOWERS. Restricts the use of leaf blowers to two hours between 9 a.m. and 5 p.m. on any day. Makes it illegal to operate a gasoline-powered leaf blower within a residential zone unless the operator is personnel of a licensed business.

RELATING TO HEALTH. Requires a county to investigate and notify the Department of Health if a report is made about a possible nuisance involving air pollution. Clarifies air-polluting nuisances. Gives the Director of Health the authority to enter a building or place and investigate reports of air-polluting nuisances. (HB754 HD1)

RELATING TO COASTAL AREAS. Makes permanent Act 160, SLH 2010. Requires maintenance of public beach accesses by adjacent landowners and imposes penalties for noncompliance. Establishes shoreline access as an objective of the coastal zone management program. Requires the department of land and natural resources to provide written notice to property owners affected by Act 160, SLH 2010.

RELATING TO PUBLIC DISCLOSURE OF FINANCIAL INTERESTS STATEMENTS. Requires a legislator to file a disclosure of financial interests between January 1 and January 31 annually.

RELATING TO JUVENILES. Permits a court to dispose of a juvenile case by referring the defendant to a restorative justice program when the court deems it would be in the best interest of the child and the child admits guilt.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing. Those wishing to provide oral testimony will be limited to two minutes.
Submit testimony in ONE of the following ways:
PAPER: 3 copies (including an original) to Room 438 in the State Capitol;
FAX: For testimony less than 5 pages in length, transmit to 808-586-8504 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or
WEB: For testimony less than 10MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.
Testimony submitted will be placed on the legislative website after the hearing adjourns. This public posting of testimony on the website should be considered when including personal information in your testimony.
