RELATING TO USE OF FORCE BY PERSONS WITH SPECIAL RESPONSIBILITY FOR CARE, DISCIPLINE, OR SAFETY OF OTHERS. Establishes types of physical force presumed unjustifiable when used to discipline minors, for purposes of responding to charges of abuse of family or household member, assault, or other criminal charges.

RELATING TO SENTENCE OF IMPRISONMENT FOR SEXUAL ASSAULT OF A MINOR UNDER THE AGE OF TWELVE YEARS. Requires the court to impose a mandatory minimum term of imprisonment without possibility of parole or probation for a person convicted of certain acts of sexual assault against a minor under the age of 12 years.

RELATING TO INTOXICATING LIQUOR. Changes classification of the offense of promoting intoxicating liquor to a minor from misdemeanor to a petty misdemeanor. Requires a minimum 24-hour imprisonment for the first offense. Authorizes longer imprisonment term for second, and third or subsequent offenses.

RELATING TO OFFENSES AGAINST VULNERABLE PERSONS. Adds the acts of killing or inflicting serious or substantial bodily injury upon a pregnant woman in the course of committing or attempting to commit a felony, to the offenses for which a person is subject to an extended or mandatory minimum term of imprisonment.

RELATING TO DISORDERLY CONDUCT. Includes within the crime of disorderly conduct impeding or obstructing the use of or access to a bus stop by laying across any bench or more than one seat provided at the bus stop or sleeping on the ground within or abutting any bus stop shelter or other bus stop structure. Effective 01/01/2014.

PROPOSING AN AMENDMENT TO THE HAWAII CONSTITUTION REGARDING THE FREEDOM OF SPEECH. Proposes a constitutional amendment to provide that freedom of speech applies only to natural persons.

RELATING TO CIVIL RIGHTS. Makes it a civil rights violation for law enforcement agencies and agents to practice biased-based policing.

RELATING TO GENDER EQUITY. Requires that the governor or appointing authority strive for gender equity when appointing members of state boards and commissions, and give priority to achieving the goal of gender equity when appointing members to vacancies, at-large positions, and alternates.

RELATING TO FUNDS TRANSFERS. Clarifies that state law on funds transfers applies to a remittance transfer unless the remittance transfer is an electronic fund transfer under the federal Electronic Fund Transfer Act of 1978, as amended.

RELATING TO THE UNIFORM ELECTRONIC LEGAL MATERIAL ACT. Establishes authentication and other requirements for selected legal materials if they are published exclusively in electronic form. Does not require electronic publication.

RELATING TO JURY SELECTION. Removes the requirement that juries be selected by the strike-and-replace method of jury impanelment.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
Submit testimony in ONE of the following ways:
PAPER: 3 copies (including an original) to Room 438 in the State Capitol;
FAX: For testimony less than 5 pages in length, transmit to 808-586-8504 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or
WEB: For testimony less than 10MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.
Testimony submitted will be placed on the legislative website after the hearing adjourns. This public posting of testimony on the website should be considered when including personal information in your testimony.
