PROPOSING AN AMENDMENT TO ARTICLE X, SECTION 1, OF THE HAWAII STATE CONSTITUTION TO PERMIT THE APPROPRIATION OF PUBLIC FUNDS FOR PRIVATE EARLY CHILDHOOD EDUCATION PROGRAMS. Proposes a constitutional amendment to permit the appropriation of public funds for private early childhood education programs, subject to non-discrimination provisions, as provided by law. RELATING TO PUBLIC LANDS. Provides several means of compensation in addition to rent reductions when the State withdraws, condemns, or takes public land leased for intensive agricultural or pastoral uses and renders the land unusable for the original purposes of the lease. Effective 07/01/2050.

RELATING TO AGRICULTURE. Authorizes the Department of Agriculture to enter into leases and other land transactions with the Agribusiness Development Corporation (ADC) for food production or organic livestock feed development. Creates a program under the ADC, with assistance of the High Technology Development Corporation, to encourage organic food production and organic livestock feed development. Exempts ADC from certain qualifying provisions to receive non-agricultural park lands for growing food or developing organic livestock feed. Effective July 1, 2050.

RELATING TO THE HAWAII EMPLOYER-UNION HEALTH BENEFITS TRUST FUND. Repeals caps on base monthly monetary amounts contributed by state and county employers to the Hawaii Employer-Union Health Benefits Trust Fund for retiree health benefit plans. Effective January 1, 2113.

RELATING TO EMPLOYER UNION HEALTH BENEFITS TRUST FUND CONTRIBUTIONS. Establishes employer contribution amounts for plan years 2011-2012 and 2012-2013 for EUTF health benefit plan premiums for the employees of collective bargaining unit (10) and their excluded counterparts. Applies retroactively to 07/01/11. Effective 7/1/50.

RELATING TO RESOLVING THE UNFUNDED LIABILITIES OF THE STATE AND THE COUNTIES. Establishes a task force to examine the unfunded liabilities of Employer-Union Health Benefits Trust Fund. Establishes the Hawaii Employer-Union Health Benefits Trust Fund Captive Insurance Company to effectively manage the administration and financing of the current and potential future employee benefit obligations of the state and county governments. RELATING TO AEROSPACE. Extends the terms of members of the aerospace advisory committee from 2 to 4 years.

RELATING TO THE GENERAL ASSISTANCE PROGRAM. Authorizes the Department of Human Services to draw from other funds appropriated by the legislature to maintain the level of general assistance benefits payments set at the beginning of each fiscal year for the entire fiscal year. Requires a report to the legislature. Effective July 1, 2050.

RELATING TO THE ESTABLISHMENT OF THE INTERIM ASSISTANCE REIMBURSEMENT SPECIAL FUND. Establishes the Interim Assistance Reimbursement Special Fund into which interim assistance reimbursements received from the SSA are deposited for repayment of state-funded financial assistance provided under the general assistance, aged, blind, and disabled, or TANF programs for recipients who are retroactively approved for supplemental security income and authorizes DHS to expend the funds for state-funded financial assistance programs. Appropriation. Effective 7/1/50.

RELATING TO THE ELDERLY. Amend section 412:3-114.5, Hawaii Revised Statutes, to require financial institutions to report instances of suspected financial abuse of an elder directly to the appropriate county police department and the Department of Human Services.

RELATING TO TIME SHARES. Requires a time share plan's disclosure of the financial obligation of the purchaser to consist of: (1) A statement that the purchaser is obligated to pay the initial price in the purchase agreement; and (2) A list or description of any additional charges. Clarifies that a sales or acquisition agent is not required to provide any promotional device or instrument to a prospective purchaser prior to making a sales presentation.

RELATING TO HEALTH. Requires health insurers, mutual benefit societies, and health maintenance organizations to provide coverage for autism spectrum disorder treatments. Effective July 1, 2112.
