MAKING AN APPROPRIATION FOR STATE LIFEGUARDS.

Appropriates funds for salaries and benefits for lifeguards for Kua Bay, Kekaha Kai state park, on the island of Hawaii an area under the jurisdiction of DLNR.

RELATING TO AGRICULTURAL LAND USE.

Allows for the construction of certain indigenous Hawaiian hale on land that is used for farming operations without a building permit.  Effective July 1, 2013.

RELATING TO AGRICULTURE.

Repeals the ability to claim expenditures for legal services under the important agricultural land qualified agricultural cost tax credit.  Effective July 1, 2050.  Applicable to taxable years beginning after December 31, 2013.

RELATING TO GOVERNMENT TORT LIABILITY.

Allows any party, including the State of Hawaii, to demand a jury trial in any action brought against the State under Chapter 662, Hawaii Revised Statutes.

RELATING TO NOTARIES PUBLIC.

Clarifies the information required to be on notary seals, authorizes the Attorney General to adjust the fees to become a notary and to renew a notary commission by rules adopted pursuant to chapter 91, Hawaii Revised Statutes, and authorizes other fees related to the regulation of notaries public to be established and adjusted by rules adopted pursuant to chapter 91, Hawaii Revised Statutes.

RELATING TO FUNDING FOR PARKING FOR DISABLED PERSONS.

Increases the state motor vehicle registration fee by $1, to be deposited into the Disability and Communication Access Board Special Fund to cover the costs of administering the parking program for persons with disabilities.  Effective January 1, 2014, and repealed January 1, 2019.

Status

RELATING TO TAXATION.

Expands application of the general excise tax to business activities in the State that are significantly associated with a seller's ability to establish or maintain a market in the State.  Creates a presumption under the general excise tax law for sellers of tangible personal property where the seller's activities in the State demonstrate a significant business nexus with the State.  Creates a presumption under the use tax law that a seller is engaged in business in the State if the seller's activities in the State demonstrate a significant business nexus with the State.

Status

RELATING TO THE HAWAII HURRICANE RELIEF FUND.

Authorizes the Hawaii Hurricane Relief Fund to conduct itself as a private entity to participate in the insurance market.  Reactivates the special mortgage recording fee.  Replenishes the Hawaii Hurricane Relief Fund.  Effective July 1, 2013.

Testimony submitted will be placed on the legislative website after the hearing adjourns.  This public posting of testimony on the website should be considered when including personal information in your testimony.
