Amends section 89-9, Hawaii Revised Statutes (HRS), to allow disputes over contributions to the Hawaii Employer-Union Health Benefits Trust Fund to be settled by way of arbitration as provided in section 89-11, HRS.  Amends section 89-11, HRS, to repeal various provisions relating to disputes over the amounts of contributions to the Hawaii Employer-Union Health Benefits Trust Fund.  Makes conforming amendments.  Effective January 1, 2113

RELATING TO THE HAWAII EMPLOYER-UNION HEALTH BENEFITS TRUST FUND.

Authorizes the board of trustees to procure certain services with an exemption from the procurement code.  Establishes trust fiduciary duties, prohibits certain transactions, and establishes liabilities for breaching a fiduciary duty.  Amends the membership, methods of appointment, and representation on the board of trustees; the selection process for filling a vacant trustee seat on the board; and the quorum requirements for voting by the board.  Authorizes the board to appoint or contract an attorney who is independent from the attorney general and establishes qualifications for the contracted attorney.  Specifies how the board shall administer and carry out the purposes of the trust fund and administratively attaches the trust fund to the department of human resources development.

Amends chapter 88, Hawaii Revised Statutes, to comply with Internal Revenue Code requirements and pre-ERISA vesting rules to maintain the Employees' Retirement System's status as a tax-qualified plan.

Corrects anomalies of service retirement service eligibility and normal and early retirement allowances for judges who became members of the Employees' Retirement System prior to July 1, 2012, and first earned service credit as a judge after June 30, 2012.

RELATING TO PROFESSIONAL EMPLOYER ORGANIZATIONS.

Repeals chapter 373L; adds definitions and registration and fee requirements to professional employer organization (PEO) law; requires notice to DOTAX of PEO violations for general excise tax exemption purposes; allows PEOs to be successor employers to client companies; establishes a sliding scale bond requirement for PEOs based upon annual payrolls.  Effective July 1, 2112.

RELATING TO WORKERS' COMPENSATION.

Requires, among other things, independent medical examinations and permanent impairment rating examinations for workers' compensation claims to be performed by physicians mutually agreed upon by employers and employees or appointed by the Director of the Department of Labor and Industrial Relations.  Allows for the use of an out-of-state physician under certain conditions.  Appropriates unspecified funds.  Effective January 1, 2113.  Repealed on June 30, 2018.

Reallocates the Barrel Tax.  Repeals the sunset date of the Barrel Tax and provides appropriations for the anticipated additional revenues. Extends the sunset date for the Energy Systems Development Special Fund until 2018.  Effective July 1, 2013.

Authorizes the Director of Finance to issue general obligation bonds to finance improvements to various irrigation systems.  Effective July 1, 2013.

RELATING TO AGRICULTURAL LOANS.

Expands the Department of Agriculture Agricultural Loan Program to provide loans for infrastructure, infrastructure improvements, the implementation of new farming techniques, and biosecurity projects.  Effective July 1, 2050.
