RELATING TO HEALTH. Requires a county to investigate and notify the Department of Health if a report is made about a possible nuisance involving air pollution. Defines air-polluting nuisances. Gives the Director of Health the authority to enter and investigate reports of air-polluting nuisances.

RELATING TO LANDFILLS. Creates a host municipality benefit fee to be assessed against landfill operators who violate solid waste pollution laws. Requires the State to distribute the fee to high schools within a five-mile radius of the penalized landfill.

RELATING TO WASTE DISPOSAL. Requires the department of health to develop and implement a voucher system for the collection and disposal of vehicle tires; appropriates funds. Effective July 1, 2013.

RELATING TO THE ENVIRONMENT. Requires that all loading operations of oil petroleum, petroleum products, and other non-miscible lighter-than-water substances in any state harbor must be surrounded by containment devices.

RELATING TO SOLID WASTE. Increases the solid waste management surcharge to $1.25 per ton of solid waste disposed of in landfills or shipped out-of-state; increases the solid waste management surcharge to 60 cents per ton of solid waste disposed of at waste-to-energy facilities that accept 150,000 tons or more of solid waste annually; provides for no surcharges to waste-to-energy facilities that accept less than 150,000 tons of solid waste annually and for ash disposed of in landfills that originates from a waste-to-energy facility; and defines "waste-to-energy facility".

RELATING TO THE DEPOSIT BEVERAGE CONTAINER PROGRAM. Removes the exemption for dietary supplements from the deposit beverage container program.

RELATING TO THE ENVIRONMENT. Requires certain businesses in the State to collect a 10-cent fee for each single-use checkout bag provided to customers. Allows businesses to retain ten per cent of the fees, subject to income and general excise taxes, for the first year. Directs use of fee revenues to fund programs to mitigate the effects of single-use checkout bags. Establishes provisions relating to violations, injunctive and other relief, county ordinances, business reporting, and audit authority. Requires annual report to the legislature. Appropriates funds.

RELATING TO MINERAL RESOURCES. Revises statutory provisions relating to the regulation of mineral resources under chapters 171 and 182, Hawaii Revised Statutes, to include geothermal within the definition of a "renewable energy producer" and to provide clarity, eliminate ambiguities, and incorporate technical, nonsubstantive changes in accordance with Act 97, Session Laws of Hawaii 2012.

RELATING TO GEOTHERMAL RESOURCES. Repeals Act 97, SLH 2012, relating to geothermal resources which differentiates between "geothermal resources exploration" and "geothermal resources development". Designates "geothermal resources exploration" and "geothermal resources development" as permissible uses in all state land use districts and certain conservation district zones in accordance with chapter 205, HRS. Enacts geothermal resource subzones, designation of areas as geothermal resources subzones, and exploratory wells, which were repealed by Act 97.

RELATING TO GREEN INFRASTRUCTURE. Establishes a regulatory financing structure that authorizes the Public Utilities Commission and the Department of Business, Economic Development, and Tourism to provide low-cost loans for green infrastructure equipment to achieve measurable cost savings and achieve Hawaii's clean energy goals.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
