Status

RELATING TO SUSTAINABILITY.

Reallocates the Environmental Response, Energy, and Food Security Tax to carry out the intended sustainability purposes of section 128D-2, Hawaii Revised Statutes, and Act 73, Session Laws of Hawaii 2010.  Repeals the sunset date in Act 73, and provides appropriations of the anticipated additional revenues. Removes the repeal date in Act 253, Session Laws of Hawaii 2007, as amended by Act 151, Session Laws of Hawaii 2012, for the Energy Systems Development Special Fund and periodic evaluation and plan of action requirements of the Energy Systems Development Special Fund.

HB 1409

Status

RELATING TO BIOFUELS.

Allocates 1.5 cents of every 15 cents of the barrel tax deposited into the energy security special fund and 1.5 cents of every 15 cents of the barrel tax deposited into the agricultural development and food security special fund, as provided in section 243-3.5, Hawaii Revised Statutes, to the agribusiness development corporation as investment capital for zero waste biofuel production.

RELATING TO PUBLIC UTILITIES.

Requires the PUC to establish preferential rates for the purchase of energy that is used or consumed for agricultural activities and eligible agricultural activities of the Department of Agriculture.  Effective July 1, 2050. (HB1148 HD1)

RELATING TO LIQUEFIED NATURAL GAS.

Requires utilities importing natural gas to file annual liquefied natural gas reports with the PUC.  Requires the PUC to open an investigative docket to examine the risks and benefits of liquefied natural gas.

RELATING TO THE PUBLIC UTILITIES COMMISSION.

Requires the public utilities commission to publish contracts, including price information, for the purchase of renewable energy by energy utilities on a publicly-accessible portion of the commission's website, with certain exceptions.

RELATING TO RENEWABLE ENERGY.

Requires an electric utility company and a producer of renewable energy who enter into a power purchase agreement to contract for a maximum number of hours per calendar year that produced renewable energy can be curtailed by the utility company.

RELATING TO PUBLIC UTILITIES.

Limits electric public utilities to delivering electricity.  Prohibits acquisition of electricity by an electric public utility power purchase agreement with an affiliated entity.  Requires electric public utilities to purchase lowest cost, nonfossil fuel generated electricity prior to purchasing fossil fuel generated electricity.  Requires PUC to establish a statewide electricity rate for utilities held by the same holding company.  Exempts utilities qualifying as a cooperation under section 501(c)(12) of the IRC.  Prioritizes geothermal as a replacement for fossil fuel.

Status

RELATING TO RENEWABLE ENERGY.

Exempts landlords and lessors who install renewable energy systems to their property from the definition of "public utility".

Status

RELATING TO SOLAR ENERGY.

Requires private entities to submit a copy of their duly adopted rules regarding the placement of solar energy devices on or before the due date of their next condominium association biennial registration.  Provides that private entities that fail to submit a copy of their rules shall lose their tax exempt status.

Status

RELATING TO WATER POLLUTION.

Establishes a separate Water Pollution Control account within existing Water Pollution Control Revolving Fund and authorizes the Director of Health to adopt through rules fees to help fund operations of the Department of Health in managing pollution from nonpoint sources and individual wastewater systems.

RELATING TO FOSSIL FUELS.

Amends section 243-3.5, HRS, to levy the environmental response, energy, and food security tax on liquid or gaseous fossil fuels.  Repeals 6/30/2015.

RELATING TO BEACH NOURISHMENT.

Appropriates funds for the environmental impact statement associated with the planned beach nourishment project at Kaanapali beach on the island of Maui; provided that no funds shall be expended unless matched dollar-for-dollar with private funds.

RELATING TO RECYCLING.

Establishes a tiered glass advanced disposal fee system based on the capacity of a glass container.
