RELATING TO ECONOMIC DEVELOPMENT. Deletes repeal of the high technology innovation corporation. Exempts high technology innovation corporation from the public procurement code.

RELATING TO HOME-BASED BAKING BUSINESS. Allows home-based baking businesses to sell food items directly to consumers if certain conditions are met. Requires the department of health to adopt rules pursuant to chapter 91, HRS, no later than December 31, 2013.

RELATING TO THE GENERAL EXCISE TAX. Narrows the scope of gross proceeds to which the general excise tax exemption for certain scientific contracts with the United States applies.

RELATING TO THE NATURAL ENERGY LABORATORY OF HAWAII AUTHORITY. Designates the chairperson of BLNR as an ex officio, nonvoting member of the board of directors of NELHA. Reduces the number of board members from 13 to 9. Eliminates one tenant position, a member of the board of the Hawaii strategic development corporation, and the secretary of the research advisory committee from the board. Limits board membership for tenant members to 8 consecutive years. Effective 07/01/13.

RELATING TO THE NATURAL ENERGY LABORATORY OF HAWAII AUTHORITY. Authorizes businesses operating within a research and technology park, in an existing enterprise zone, to receive same benefits available to other businesses in the same enterprise zone. Authorizes the projects of the Natural Energy Laboratory of Hawaii Authority, conducted within state enterprise zones, to receive the same benefits available to other businesses in the same enterprise zone.

RELATING TO ECONOMIC DEVELOPMENT. Establishes the state smart growth public infrastructure policy. Requires state agencies involved in the planning, development, and financing of public infrastructure to consider smart growth criteria prior to approving or financing any public infrastructure projects. Requires the executive officers of each state agency involved in the planning, development, and financing of public infrastructure projects to attest that a project meets the smart growth criteria or prepare a statement of justification. Requires each state agency involved in the planning, development, and financing of public infrastructure to create a smart growth advisory committee. Precludes any private right of action. Takes effect on July 1, 2014.

RELATING TO ECONOMIC DEVELOPMENT. Extends the tax credit for qualified research activities for an additional five years. Clarifies the method of calculating the tax credit. Amends the definition of "qualified high technology business". Repeals existing certification requirements and establishes new reporting requirements. Requires the department of business, economic development, and tourism to conduct studies to measure the effectiveness of the tax credit and submit reports to the legislature.

RELATING TO BROADBAND. Requires the State and the counties to approve, approve with modification, or disapprove all broadband-related permits within sixty business days of submitting a permit application and a fee; provided that if no action is taken on the sixty-first business day, the application will be deemed approved. Effective upon approval, and repealed on June 30, 2018.

RELATING TO TAXATION. Reestablishes the temporary income tax credit for research activities. Requires a qualified high technology business that claims the tax credit for research activities to file annual survey information with the department of taxation by June 30 of each year. Requires the department of taxation to report to the legislature by September 1 of each year on the information collected by the survey and the effectiveness of the tax credit.

RELATING TO LIQUOR TAX LAW. Reduces the gallonage tax on the first 60,000 barrels of beer brewed or produced during a taxable year by a small brewery or brewpub in the State to $0.23 per gallon of beer.

RELATING TO ADVERTISING AND MARKETING. Requires beers sold or distributed in the State whose labels convey the impression that the beers were produced in Hawaii to indicate otherwise if not produced in the State.

RELATING TO LIQUOR. Establishes new class of Liquor Commission licensees for distillery pubs.

RELATING TO EDUCATION. Increases the General Excise Tax and Use Tax for certain, specified services and commodities by one percent. Directs the realizations of twenty percent of such taxes to the Department of Education for the operations of the Department under state law.
