RELATING TO ESCROW DEPOSITORIES.

Requires escrow depositories to report any change of their corporate designated escrow officer or branch manager to the Commissioner of Financial Institutions; establishes a statutory fee for the transfer or change in control of an escrow depository license; increases the fidelity bond maintained by escrow depositories to a minimum of $100,000; increases the errors and omissions policy amount escrow depositories are required to carry to not less than $250,000; increases fees; provides powers for the commissioner to supervise and regulate the industry; empowers the commissioner to issue cease and desist orders; increases net capital requirement to $100,000.  Effective July 1, 2050.  (SD2)

Prohibits persons convicted of cruelty to animals in the first degree and second degree from possessing, owning, or residing with any pet animal for a minimum of five years and one year, respectively, from the conviction date.  Effective 07/01/50.  (SD1)

RELATING TO VETERINARY MEDICINE.

Prohibits the owner of a pet animal and the owner's employees from performing any surgical procedure, including but not limited to surgical birth, ear cropping, tail docking, dewclaw removal, and debarking on the pet animal without being licensed as a veterinarian.  Makes intentionally or knowingly performing any surgical procedure, including but not limited to surgical birth, ear cropping, tail docking, dewclaw removal, and debarking, on a pet animal by any person not licensed as a veterinarian a class C felony.  Specifies that accepted veterinary practices and cropping or docking as customarily practiced, shall not be considered cruelty to animals in the first degree if performed by a veterinarian licensed under chapter 471, HRS.  (SD1)

RELATING TO TRANSIENT ACCOMMODATIONS.

Clarifies that an association's duty to report to DOTAX is limited to the relevant information and the name, address, and contact information of a local contact an association actually receives from a transient accommodation operator.  Clarifies that the fines imposed for wilfully failing to supply required information shall be limited to civil penalties imposed no more than once a year.  Effective 07/01/2050.  (SD2)

RELATING TO MORTGAGE LOAN ORIGINATION.

Raises application and renewal fees for mortgage loan originators, mortgage loan originator companies, and exempt sponsoring mortgage loan originator companies; and establishes fees for mortgage servicer companies that conduct mortgage loan origination activities.  Substitutes the word "NMLS" wherever the words "the Nationwide Mortgage Licensing System", or similar term, appears, as the context requires.  Effective 7/01/2050.  (SD2)

RELATING TO EDUCATION.

Establishes the Post-secondary Education Commission within the Department of Commerce and Consumer Affairs.  Creates the framework for authorizing private post-secondary educational institutions in the State.  Repeals the Post-secondary Education Commission within the University of Hawaii.  Creates the post-secondary education authorization subaccount of the compliance resolution fund.  Includes provisions for transition and implementation.  Effective July 1, 2013.  (SB46 HD1)

RELATING TO THE ELDERLY.

Amend section 412:3-114.5, Hawaii Revised Statutes, to require financial institutions to report instances of suspected financial abuse of an elder directly to the appropriate county police department and the Department of Human Services.  (SD2)

RELATING TO THE STATE BUILDING CODE COUNCIL.

Reconfigures the membership of the state building code council by eliminating the member from the department of health and adding members from the Building Industry Association; General Contractors Association; Hawaii Construction Alliance; Subcontractors' Association of Hawaii; department of business, economic development, and tourism; department of accounting and general services; Hawaii Building and Construction Trades Council; and American Council of Engineering Companies.  Changes the requirements for a quorum from six to nine.  Eliminates the council's obligation to consult with private sector representatives regarding construction practices and training.  Makes an appropriation.  Effective 7/1/2050.  (SD2)

RELATING TO ANIMALS.

Permits a landlord to hold a tenant's security deposit for the purpose of paying for damages caused by a pet animal residing in the premises.  Authorizes a landlord as a condition of a rental agreement to add to the security deposit an amount for a pet animal to reside in the premises; provided that no landlord shall require any additional security deposit amount for an assistance animal that is a reasonable accommodation for a tenant with a disability.  Effective for rental agreements entered into on or after 11/01/2013.  (SD1)

RELATING TO INSURANCE.

Implements the recommendations of the motor vehicle insurance verification working group.  Establishes a working group attached to DCCA to assist in development of requests for proposals and vendor selection for a motor vehicle insurance verification program.  Establishes a special fund to develop and operate the motor vehicle insurance verification program.  Removes duplicative and unnecessary requirements for insurance identification cards and safety inspection requirements.  Removes judges' discretionary authority to suspend a fine for failure to have insurance if a defendant later obtains insurance.  Effective July 1, 2050.  Sunsets June 30, 2020.  (SB495 HD1)

RELATING TO REAL ESTATE SELLER DISCLOSURE.

Establishes a uniform standard for disclosure for condominium projects, cooperative housing corporations, and other community associations and clarifies the types of documents that are required to be disclosed.  Requires the disclosure of documents within ten days after the title report is received.  Allows for the electronic receipt of documents with the buyer's consent.  Effective 07/01/2050.  (SD1)

RELATING TO PROFESSIONAL EMPLOYER ORGANIZATIONS.

Repeals chapter 373L; adds definitions and registration and fee requirements to professional employer organization (PEO) law; requires notice to DOTAX of PEO violations for general excise tax exemption purposes; allows PEOs to be successor employers to client companies; establishes a sliding scale bond requirement for PEOs based upon annual payrolls.  Effective July 1, 2112.  (SB510 HD1)

RELATING TO AGRICULTURE.

Adds to the definition of agricultural commodities exempt from the general excise tax: beef and beef carcasses; goat meat and goat carcasses; lamb meat and lamb carcasses; sheep meat and sheep carcasses; milk; eggs; poultry meat and poultry carcasses; and aquaculture and aquaponic products to be consumed in the State, whether processed in the State or imported.  Effective July 1, 2050.  (SB595 HD1)

RELATING TO THE HOUSING LOAN AND MORTGAGE PROGRAM.

Updates the Hula Mae Single Family Mortgage Loan Program to allow broader program participation by potential homeowners, add downpayment and other cost assistance as a program feature, and make housekeeping and conforming amendments.  Effective July 1, 2030.  (SB1025 HD1)

RELATING TO MONEY TRANSMITTERS.

Authorizes the Commissioner of Financial Institutions to require money transmitters to register with NMLS.  Establishes procedures for a licensed money transmitter to surrender its license.  Amends the bond requirement, the fee structure for services provided by the Division of Financial Institutions of the DCCA for the regulation of money transmitters, and the fine for violations of money transmitter regulations.  Effective 7/1/2050.  (SD2)

RELATING TO GREEN INFRASTRUCTURE.

Establishes a regulatory financing structure that authorizes the PUC and DBEDT to provide low-cost loans for green infrastructure equipment to achieve measurable cost savings and Hawaii's clean energy goals.  Requires a report to the legislature.  Appropriates funds.  (SB1087 HD1)

RELATING TO EXEMPTIONS FROM CHILD CARE LICENSING.

Allows a child care program licensed by the United States Department of Defense or the Hawaii Council of Private Schools to be exempt from licensing by the Department of Human Services.  In order for a child care program licensed by the Hawaii Council of Private Schools to be exempt from licensure by the Department of Human Services, the child care program must apply and show evidence that the licensing standards of the Hawaii Council of Private Schools meet or exceed the licensing standards of the Department of Human Services, and that the standards include a monitoring system that ensures compliance with the standards.  (SD2)

RELATING TO PEDIATRIC DENTAL HEALTH COVERAGE.

Requires the Hawaii health connector to ensure that all individuals under age nineteen purchase Federal Act essential benefits including pediatric dental coverage under a health plan.  Effective 07/01/2050.  (SD2)
