A BILL FOR AN ACT
relating to public housing.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 356D-10, Hawaii Revised Statutes, is amended to read as follows:
"[[]§356D-10[]] Agents,
including corporations. (a) The authority may exercise any or all
of the powers conferred upon it, either generally or with respect to any
specific public housing project through an agent that it may designate,
including any corporation that is formed under the laws of this State, and for
those purposes the authority may cause one or more corporations to be formed
under the laws of this State or may acquire the capital stock of any
corporation. Any corporate agent, all of the stock of which shall be owned by
the authority or its nominee, may to the extent permitted by law, exercise any
of the powers conferred upon the authority in this chapter.
(b) Notwithstanding any law to the contrary, if the authority determines that the authority or another state agency is unable to efficiently and effectively carry out the purposes of this chapter, the authority may contract with a corporation described under subsection (a) to provide management and other services described in subsection (c) to support the authority's programs. Authority projects and programs supported by funds appropriated by or grants from the legislature or the federal government may also be contracted to the corporation.
(c) Management and other support services provided by a corporation who is contracted by the authority pursuant to this section may include but not be limited to:
(1) Procurement of goods and services;
(2) Employment of personnel;
(3) Advancement of funding for low-income housing contracts and grants; and
(4) Development of property and management of construction services.
These services may be provided to the authority by a corporation without regard to chapters 76, 78, 89, and 103D.
(d) For purposes of this section, "corporation" may include a public housing affiliate or instrumentality entity as defined and regulated by the federal government."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
