A BILL FOR AN ACT

 

 

relating to the hawaii public housing authority.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 356D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§356D-    Lease or rent to nonprofit organizations and government agencies.  (a)  The authority may retain dwelling units or community facilities in a housing project to the extent it determines necessary and appropriate, for lease or rent to nonprofit organizations and government agencies.  The dwelling units or community facilities shall be used by the nonprofit organizations and government agencies to provide housing opportunities and related support services to individuals or families of low income or with special needs.  These purposes include but shall not be limited to the use of dwelling units for group homes and congregate living facilities and for government employees in special situations.  The authority, in consultation with other appropriate government agencies, shall adopt rules pursuant to chapter 91 necessary to implement this subsection, including but not limited to rules relating to the eligibility and qualifications of nonprofit organizations and government agencies; the eligibility and qualifications of clients of nonprofit organizations and government agencies to whom housing opportunities may be made available; and restrictions on the use or transfer of dwelling units leased or rented pursuant to this subsection.

     The authority, to the extent appropriate, shall have the same powers with respect to nonprofit organizations and government agencies leasing or renting dwelling units as the authority has with respect to qualified residents leasing or renting dwelling units.

     (b)  In connection with the improvement of any dwelling units under this chapter, the authority may provide for the development of appropriate community facilities.  The authority may:

     (1)  Lease or rent vacant land or land with site improvements to nonprofit organizations and government agencies to develop community facilities; or

     (2)  Develop, on behalf of the State or with an eligible developer, community facilities, and then lease, rent, or otherwise make available these facilities to nonprofit organizations and government agencies.

     In selecting eligible nonprofit organizations or eligible developers for the purposes of this section, the authority shall be subject to all federal procurement laws and regulations."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
