A BILL FOR AN ACT

 

 

RELATING TO PRESCRIPTION MEDICATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Seriously ill health, such as conditions requiring an organ transplant, may at times compel a Hawaii resident to wait for or receive medical care on the mainland.  A patient requiring out of state treatment may not have family or friends here who are able or willing to mail their medications to them in the state where he is receiving the necessary medical care.  Hawaii pharmacies, while authorized to mail prescriptions to a patient in-state, are currently not authorized to mail those same needed prescriptions to a patient who is temporarily residing elsewhere for reasons of medical treatment.

     SECTION 2.  Chapter 461, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§461-23  Patient temporarily out of state.  A pharmacy qualified under this chapter shall be authorized to mail drugs or patent medicines prescribed by a Hawaii physician to patients who are temporarily residing out of the state while receiving or pending medical treatment in another state.  The pharmacy shall mail such prescription drugs or patent medicine to the patient at the out of state address of a patient upon request of the patient.  The request form shall be signed by the physician ordering the medication, with a statement that the patient is required to be out of state during or pending medical treatment in another state, and the approximate dates of that temporary out of state residence.  On the request form, the patient shall provide the pharmacy with a valid address to which the prescribed medication is to be mailed.  The authority and duty of the pharmacy to mail such medications to the patient residing temporarily out of state shall be for the duration of the out of state residence as stated by the prescribing physician on the request form."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
