A BILL FOR AN ACT

 

 

RELATING TO CORRECTIONS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 353, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§353-    Committed persons; sale of products and crafts. (a)  The department shall permit committed persons, at the director's discretion, to create products and crafts for sale including photographs, paintings, drawings, sewn items, crocheted items, woodwork, and other items deemed sellable by the director.

     (b)  Products and crafts may be sold by the director at a location deemed appropriate by the director, including electronic website postings or in stores.

     (c)  Of the proceeds from the sale of products and crafts:

     (1)            per cent shall be deposited into the committed person's current facility's fund for re-entry or rehabilitation services or programs;

     (2)            per cent shall be deposited into the crime victim compensation special fund established by section 351-62.5; and

     (3)            per cent shall be deposited into an account of the committed person established pursuant to section 353-20."

     SECTION 2.  Section 351-62.5, Hawaii Revised Statutes, is amended by amending subsection (d) to read as follows:

     "(d) Funds received pursuant to section 354D-12(b)(1) and amounts received pursuant to sections 351-35, 351-62.6, 351-63, 353-  , 706-605, and 853-1 shall be deposited into the crime victim compensation special fund.  Moneys received shall be used for compensation payments, operating expenses, salaries of positions as authorized by the legislature, and collection of fees.  The commission may enter into memorandums of agreement with the judiciary for the collection of fees by the judiciary; provided that no funds shall be deposited by the judiciary into the crime victim compensation special fund until collected."

     SECTION 3.  The department of public safety shall conduct a study to ascertain the practices of correctional facilities in other states with regard to the making and sale of arts and crafts by inmates.  The study shall include information on the means by which the items are sold, the price of the articles, and the allocation of proceeds from sales.

     The department of public safety shall report its findings and recommendations to the legislature no later than twenty days prior to the convening of the regular session of 2014.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2050.

Description:

Allows committed persons to create and place for sale approved products and crafts. Allocates proceeds to rehabilitation programs, the crime victim compensation special fund, and the committed person's account. Requires department of public safety to study other states' practices on the making and sale of arts and crafts by inmates.
