A BILL FOR AN ACT
RELATING TO SERVICE AWARDS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§302A- Employees; annual bonus. No employee hired or whose contract is renewed after July 1, 2013, and whose salary is more than $275,000 shall receive an annual bonus or award in excess of $25,000."
SECTION 2. Section 78-29, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:
"(b) The programs may provide for cash
awards to recognize suggestions, inventions, superior accomplishments, length
of service, and other personal or group efforts[.]; provided that no annual
cash award in excess of $25,000 shall be awarded to any employee hired or whose
contract is renewed after July 1, 2013, and whose base salary is more than
$275,000. A cash award shall be in addition to the employee's regular
compensation. The acceptance of a cash award shall constitute an agreement
that use by the government of any idea, method, or device for which the award
is made shall not form the basis of a further claim upon the government by the
employees or the employees' heirs and assigns."
SECTION 3. Section 304A-1001, Hawaii Revised Statutes, is amended to read as follows:
"[[]§304A-1001[]] Exempt
personnel. Personnel of the university not subject to chapter 76 shall be
under the direction of the president of the University of Hawaii. The board of
regents shall appoint deans, directors, members of the faculty, and other
employees as may be required to carry out the purposes of the institution,
prescribe their salaries and terms of service when the salaries and terms of
service are not specifically fixed by legislative enactment, and make and
enforce rules governing sabbatical and professional improvement leaves with or
without pay, consistent with the practice of similar institutions in the United
States and notwithstanding the laws of the State relating to leaves of absence
of the officers and employees of the State[.]; provided that no annual
cash bonus or award in excess of $25,000 shall be given to any employee hired
or whose contract is renewed after July 1, 2013, and whose base salary is more
than $275,000."
SECTION 4. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 5. If any provision of this Act, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the Act that can be given effect without the invalid provision or application, and to this end the provisions of this Act are severable.
SECTION 6. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 7. This Act shall take effect upon its approval.
