A BILL FOR AN ACT
RELATING TO HIGHWAY TRAFFIC SAFETY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§291C- Commercial motor vehicles; drive on right side of roadway; exceptions. (a) Upon any roadway having four or more clearly marked lanes for traffic in one direction, the operator of a commercial motor vehicle shall use the traffic lane that is as near to the right side of the roadway as practicable.
(b) When overtaking and passing another vehicle proceeding in the same direction, the operator of a commercial motor vehicle shall use the lane to the immediate left of the right-hand lane.
(c) For the purposes of this section, "commercial motor vehicle" has the same meaning as defined under section 286-2.
(d) This section shall not apply to an operator of a commercial motor vehicle who is:
(1) Preparing for a left- or right-hand turn;
(2) In the process of entering into or exiting from a highway;
(3) Avoiding an obstruction in the road; or
(4) Complying with the requirements of section 291C-27."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
