A BILL FOR AN ACT

 

 

RELATING TO THE DEFINITION OF PUBLIC HOUSING PROJECT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The current definition of "public housing project" is inaccurate and unnecessarily restrictive for purposes of the federal low-income public housing program.  The definition also limits development of the State's affordable housing properties and limits revenue sources.

     The purpose of this Act is to amend the definition of "public housing project" to be consistent with federal law to allow the Hawaii public housing authority to benefit from federal programs and ensure that amendments to federally assisted housing options are automatically incorporated into the Hawaii public housing authority's program administration. 

     SECTION 2.  Section 356D-1, Hawaii Revised Statutes, is amended by amending the definition of ""public housing project", "housing project", or "complex"" to read as follows:

     ""Public housing project", "housing project", or "complex" means a housing project directly controlled, owned, developed, or managed by the authority [pursuant to the federal low-rent public] as federally assisted housing [program.], as defined in 24 Code of Federal Regulations section 5.100."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
