A BILL FOR AN ACT
RELATING TO TRANSPORTATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 266, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§266- Exemption from conservation district permitting and site plan approval requirements. Where there exist environmental regulatory compliance requirements in chapter 343, federal laws or regulations applicable to the United States Army Corps of Engineers or Environmental Protection Agency, or any other applicable law, all work involving submerged lands used for existing state commercial harbor purposes shall be exempt from permitting and site plan approval requirements established for lands in a conservation district. This exemption shall be applicable to expedite any maintenance work to rehabilitate and upgrade the State's existing commercial harbors system."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 2020.
