HOUSE CONCURRENT
RESOLUTION
Requesting the chairperson of the board of land and natural resources to establish A COASTAL MEMORIALs TASK FORCE.
WHEREAS, the natural beauty of Hawaii's coastlines is a unique and important feature to our island state; and
WHEREAS, the preservation of this natural beauty is of the utmost importance; and
WHEREAS, allowing public access to our coastlines and coastal areas ensures that residents and visitors alike are able to enjoy and experience the natural beauty of our island state; and
WHEREAS, ensuring the safety of the public and visitors accessing coastal areas and coastlines necessitates the creation and implementation of policies governing permissible activities; and
WHEREAS, many members of the public erect memorials on the coastlines and coastal areas of our islands in remembrance of loved ones who have passed; and
WHEREAS, in order to preserve public access to our coastlines and coastal areas as well as ensure the safety of the public when accessing those areas, there is a need to evaluate and consider the creation and implementation of policies regarding the creation of those coastal memorials; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-seventh Legislature of the State of Hawaii, Regular Session of 2013, the Senate concurring, that the Chairperson of the Board of Land and Natural Resources is requested to establish a Coastal Memorials Task Force; and
BE IT FURTHER RESOLVED that the Task Force consist of eleven members, including the following members:
(1) The chairperson of the board of land and natural resources or the chairperson's designee;
(2) The director of transportation or the director's designee;
(3) A member of the house of representatives, appointed by the speaker of the house of representatives;
(4) A member of the senate, appointed by the senate president;
(5) One representative from each county, appointed by the respective mayor;
(6) A member of the community, appointed by the speaker of the house of representatives;
(7) A member of the community, appointed by the president of the senate; and
(8) A member of the community, appointed by the governor; and
BE IT FURTHER RESOLVED that all members of the Task Force be appointed no later than 30 days after the last day of the regular session of 2013 and that the Task Force convene its first meeting within 30 days of the appointment of its last member; and
BE IT FURTHER RESOLVED that the Task Force:
(1) Review and evaluate the practice of erecting coastal memorials with respect to the safety of beach users;
(2) Develop standards to regulate the practice of erecting coastal memorials; and
(3) Consider the size, placement, and duration of coastal memorials in its review; and
BE IT FURTHER RESOLVED that the Task Force submit a report of its findings and recommendations, including proposed legislation, to the Legislature no later than 20 days prior to the convening of the Regular Session of 2014; and
BE IT FURTHER RESOLVED that no member of the Task Force shall be made subject to Chapter 84, Hawaii Revised Statutes, solely because of that member's participation as a member of the Task Force; and
BE IT FURTHER RESOLVED that the Legislative Reference Bureau is requested to assist the task force in preparing its findings, recommendations, and proposed legislation; provided that the Chairperson of the task force is requested to submit a draft of the task force's recommendations to the Legislative Reference Bureau for drafting no later than November 1, 2013; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources; Director of Transportation; Mayor of each county; Chair of the County Council for each county including the City Council of the City and County of Honolulu; Chairperson of the Senate Standing Committee on Water and Land; Chairperson of the House of Representatives Standing Committee on Water & Land; and Acting Director of the Legislative Reference Bureau.
