A BILL FOR AN ACT

 

 

relating to environmental rehabilitation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 210D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§210D-     Community environmental rehabilitation special fund.  (a)  There is established in the state treasury a community environmental rehabilitation special fund.

     (b)  The following moneys shall be deposited into the community environmental rehabilitation special fund:

     (1)  Ten per cent of all moneys received by the State as payment for fines or penalties for environmental violations assessed by the State;

     (2)  Any appropriation by the legislature into the community environmental rehabilitation special fund;  

     (3)  Any gift, grant, or donation made to the community environmental rehabilitation special fund; and

     (4)  Any interest earned on sums deposited into the community environmental rehabilitation special fund. 

     (c)  The department shall expend moneys contained in the community environmental rehabilitation special fund to restore, improve, or rehabilitate communities affected by the environmental violations from which the moneys in subsection (b)(1) were generated."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
