A BILL FOR AN ACT

relating to rules of the road.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Section 291C-49, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§291C-49[]]  Driving on laned roadways [laned for traffic]; requiring heavy trucks to drive within the right-hand lane.  Whenever driving on any laned roadway [has been divided into two or more clearly marked lanes for traffic] the following rules in addition to all others consistent herewith shall apply.

     (1)  A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from the lane until the driver has first ascertained that such movement can be made with safety[.];

     (2)  Upon a roadway which is divided into three lanes and provides for two-way movement of traffic, a vehicle shall not be driven in the center lane except when overtaking and passing another vehicle traveling in the same direction when the center lane is clear of traffic within a safe distance, or in preparation for making a left turn or where the center lane is at the time allocated exclusively to traffic moving in the same direction that the vehicle is proceeding and such allocation is designated by official traffic-control devices[.];

     (3)  Official traffic-control devices may be erected directing specified traffic to use a designated lane or designating those lanes to be used by traffic moving in a particular direction regardless of the center of the roadway and drivers of vehicles shall obey the directions of every such sign[.];

     (4)  Official traffic-control devices may be installed prohibiting the changing of lanes on sections of roadway and drivers of vehicles shall obey the directions of every such device[.]; and

(5) Upon an interstate highway, a heavy truck shall be driven as nearly as practicable entirely within the right-hand lane, except when making a left turn or when an obstruction exists making it necessary to drive to the left of the right-hand lane; provided that the heavy truck shall not be moved from the lane until the driver has first ascertained that such movement can be made with safety.

As used in this paragraph:

"Heavy truck" means any motor vehicle having a gross vehicle weight rating of more than ten thousand pounds and is designed or used primarily for the carriage of property other than effects of the driver or passengers, and includes a motor vehicle to which has been added a box, platform, or other equipment for such carriage.

"Interstate highway" means the Dwight D. Eisenhower National System of Interstate and Defense Highways which is a network of freeways that forms a part of the National Highway System of the United States."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
