A BILL FOR AN ACT

relating to human services.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346-  Advance health-care directive; medicaid. (a)  All medicaid recipients shall provide to the department a current advance health-care directive, or in the alternative, a completed advance health-care directive optional form, as set forth in section 327E-16.

(b)  If the medicaid recipient chooses to complete the optional form set forth in section 327E-16, the advance health care optional form shall be provided to the recipient by the department of human services.

(c)  The advance health-care directive or optional form shall be retained by the department and filed in the recipient's medical file.

(d)  An advance health-care directive that conflicts with an earlier advance health-care directive shall supersede the earlier directive to the extent of the conflict.

(e)  All provisions in chapter 327E shall apply to advance health-care directives created under this section."

     SECTION 2.  New statutory material is underscored.

SECTION 3.  This Act shall take effect upon its approval.
