A BILL FOR AN ACT
rELATING TO AGRICULTURAL LAND USE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§46- Traditional Hawaiian hale. (a) Any law to the contrary notwithstanding, each county shall allow the construction of traditional Hawaiian hale on land that is used for farming operations as defined in section 165-2, including for use as greenhouses and sheds, without requiring a building permit.
(b) For purposes of this section, "traditional Hawaiian hale" means a nonresidential structure that:
(1) Is a permitted use within the zoning designation of the land;
(2) Is not more than five hundred square feet in size;
(3) Does not exceed $ in total construction cost;
(4) Has no kitchen or bathroom;
(5) Is single-wall construction; and
(6) Contains not more than cubic feet of concrete."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 2013.
