A BILL FOR AN ACT

 

 

relating to ziplines.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

"Chapter

ziplines

     §   -A  Definitions.  For the purposes of this chapter, the following terms shall mean as follows:

     "Department" means the department of commerce and consumer affairs.

     "Director" means the director of commerce and consumer affairs.

     "Oversight board" means the ziplines oversight board.

     "Special fund" means the ziplines special fund.

     §   -B  Ziplines oversight board; established.  (a)  There is established within the department for administrative purposes only the ziplines oversight board for the purposes of promoting best practices and procedures within the ziplines industry in the State.

     (b)  The oversight board shall consist of not less than four members, three of whom shall be owners or operators of zipline businesses in the State who shall be appointed by the governor in accordance with section 26-34.  The director, or the director's designee, shall serve as an ex officio member of the oversight board and shall serve as the chairperson.

     §   -C  Powers; duties.  The oversight board shall have the following powers and duties:

     (1)  Establish best practices and procedures;

     (2)  Adopt rules pursuant to chapter 91 that shall:

          (A)  Require zipline operators to register with the department;

          (B)  Provide for fees to be assessed and collected; provided that the fees shall represent an assessment either per operator, per customer, or any other fair and equitable mechanism that shall be developed to sustain the operations of the oversight board and reimburse the oversight board for their administrative expenses; and

          (C)  Enforce compliance with the rules by providing for fines and penalties for violation of the rules;

     (3)  Engage in all other duties and functions necessary for the purposes of this chapter.

     §   -D  Ziplines special fund; established.  There is established within the state treasury the ziplines special fund, into which shall be deposited all fees and fines collected pursuant to section    -C and any appropriation from the legislature.  All interest and investment moneys earned on any moneys in the special fund shall become part of the special fund.

     (b)  The purpose of the special fund shall be to provide for sufficient operating costs to carry out the purposes of this chapter.

     (c)  The director shall submit a report to the legislature on the status of the special fund, including expenditures and program results, not less than twenty days prior to the convening of each regular session."

     SECTION 2.  In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

     SECTION 3.  This Act shall take effect upon its approval.
