A BILL FOR AN ACT
relating to endangered species.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 195D-26, Hawaii Revised Statutes, is amended to read as follows:
"[[]§195D-26[]] Annual
report; endangered species. (a) The department, after consultation
with the endangered species recovery committee, by December 31 of each year,
shall prepare a report summarizing:
(1) The status of all endangered, threatened, proposed, and candidate species for which incidental take licenses pursuant to sections 195D-4 and 195D-22 have been issued and the effectiveness of all habitat conservation plans and safe harbor agreements that have been approved;
(2) The condition of the trust fund established under this chapter, including receipts and expenditures over the previous fiscal year; and
(3) Any recommendations to further the purposes of this chapter.
(b) In addition to the annual report required under subsection (a), the department, by June 30 of each year, shall prepare a report providing the most recent historical, current, and projected population counts for all endangered species of aquatic life and wildlife that inhabit state marine waters and the coastal lands of the State.
[The report] (c) The reports
required under subsections (a) and (b) and all information pertaining to
incidental take licenses shall be made available to the public."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
