A BILL FOR AN ACT
relating to impact fees.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that currently, all premises in need of water service are not required to obtain building permits. Consequently, the boards of water supply in each county lack the ability to collect impact fees at the time a commitment or allocation of water resources is needed.
The purpose of this Act, therefore, is to authorize the assessment and collection of a portion of impact fees as a condition to a commitment or allocation of water resources, with payment in full required prior to the issuance of a water meter.
SECTION 2. Section 46-141, Hawaii Revised Statutes, is amended by amending the definition of "development" to read as follows:
"Development" means any artificial change to real property that requires a grading or building permit as appropriate, including, but not limited to, construction, expansion, enlargement, alteration, or erection of buildings or structures and any issuance of a water meter that does not require a permit.
SECTION 3. Section 46-146, Hawaii Revised Statutes, is amended to read as follows:
"[[]§46-146[]] Time of
assessment and collection of impact fees. (a) Assessment of impact
fees shall be a condition precedent to the issuance of a water meter or grading
or building permit and shall be collected in full before or upon issuance of
the water meter or permit.
(b) A board may collect a portion of the impact fee at the time the board makes a commitment or allocation of water resources."
SECTION 4. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 5. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 6. This Act shall take effect upon its approval.
