A BILL FOR AN ACT

 

 

relating to controlled-access facilities.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 264-64, Hawaii Revised Statutes, is amended to read as follows:

     "§264-64  Design of controlled-access facility and regulation, restriction, or prohibition of access; penalty.  (a)  The director of transportation may so design any controlled-access facility and so regulate, restrict, or prohibit access as to best serve the traffic for which such facility is intended.  In this connection, the director may divide and separate any controlled-access facility into separate roadways by the construction of raised curbing, central dividing sections, or other physical separations, or by designating the separate roadways by signs, markers, stripes, and the proper lane for the traffic by appropriate signs, markers, stripes, and other devices.

     (b)  The director of transportation shall designate the right shoulder lane of the east-bound lanes of the controlled-access facility known as H-1 for use by through traffic beginning at exit 15A and ending at exit 1.  The director's designation pursuant to this subsection shall be effective on weekdays from 5:30 a.m. until at least 10:00 a.m, except for state or federal holidays.

     (c)  No person shall have any right of ingress or egress to, from, or across controlled-access facilities to or from abutting lands, except at the designated points at which access may be permitted, upon such terms and conditions as may be specified by the director.  Any person who violates this section shall be fined not more than $250 or imprisoned not more than three months, or both."

     SECTION 2.  The director of transportation shall seek approval of the designation of the right shoulder lane of the east-bound controlled-access facility known as H-1 for through traffic pursuant to this Act from the United States Department of Transportation as required by federal law.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval; provided that the director of transportation's designation under section 264-64(b), Hawaii Revised Statutes, shall not be
implemented until approval therefor is obtained from the United States Department of Transportation.
