PROPOSING AMENDMENTS TO THE HAWAII CONSTITUTION, TO BOTH REQUIRE THE LEGISLATURE TO ENACT LAWS TO AUTHORIZE THE COUNTIES TO ISSUE TAX INCREMENT BONDS AND TO EXCLUDE THE BONDS FROM DETERMINATIONS OF THE FUNDED DEBT OF THE COUNTIES. Proposes a constitutional amendment to both require the legislature to enact laws to authorize the counties to issue tax increment bonds and to also exclude the bonds from determinations of the funded debt of the counties.

PROPOSING AN AMENDMENT TO ARTICLE XI OF THE HAWAII CONSTITUTION TO PROVIDE DEDICATED FUNDING FOR THE HAWAII STATEWIDE TRAIL AND ACCESS PROGRAM AND THE STATE PARKS SPECIAL FUND. Proposes a constitutional amendment that requires .001% of GET revenues to be allocated to the special land and development fund for the Hawaii statewide trail and access program and the state parks special fund.

RELATING TO STATE PARKS AND TRAILS. Requires that one-half of .001% of GET revenues be allocated each to the special land and development fund for the Hawaii statewide trail and access program and the state parks special fund. Effective upon constitutional amendment.

RELATING TO PRIVATE TRANSFER FEES. Makes permanent the prohibition of private fees for a future transfer of real property.

RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY. Requires the HCDA to engage in efforts to re-acquire the makai gateway park and the Honolulu Ford parcel in Kakaako. Requires, after re-acquisition, the development of those parcels into medical or scientific uses that contribute to the synergy created by the school of medicine and UH cancer center.

RELATING TO THE LAND USE COMMISSION. Prohibits members of the land use commission from voting on action taken by the commission if there is a conflict of interest.

RELATING TO THE PUBLIC LAND DEVELOPMENT CORPORATION. Adds 2 new members of the board of directors of the PLDC. Requires that the Hawaii public land optimization plan provide for the protection of cultural practices. Requires the PLDC to comply with certain provisions of law relating to the alienation of land and the OHA's pro rata portion of the public land trust.

MAKING AN APPROPRIATION FOR THE HAWAII ASSOCIATION OF CONSERVATION DISTRICTS. Appropriates funds for the Hawaii Association of Conservation Districts to assist with its staffing and operating costs. Effective July 1, 2012.

RELATING TO THE HAWAII LEGACY TRUST FUND. Establishes the Hawaii legacy trust fund as a separate fund of the Hawaii Community Foundation to encourage individuals to make strong financial investments while supporting conservation, reforestation, environmental stewardship, sustainability, affordable housing, public education, and the well-being of the State's keiki and kupuna.

RELATING TO CONSERVATION AND RESOURCES. Establishes penalties for the destruction or harvesting of native sandalwood trees. Requires replanting for trees harvested. Bans the export of raw or unprocessed sandalwood timber. Establishes DLNR policies regarding sandalwood.

RELATING TO KANAKA MAOLI FISHPONDS. Provides state lease preferences for the reconstruction, restoration, repair, or use of kanaka maoli fishponds. Defines kanaka maoli fishponds as Hawaiian fishponds. Effective July 1, 2012.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
