RELATING TO TRANSPORTATION.

Amend chapter 266, Hawaii Revised Statutes, to exempt the Department of Transportation, Harbors Division, from the permit and site plan approvals requirements relating to submerged lands within the conservation district.

RELATING TO PARKING FOR DISABLED PERSONS.

Authorizes blind and visually impaired persons to apply for and obtain disability parking permits.  Effective July 1, 2050.  (HB2104 HD1)

Status

RELATING TO PUBLIC ORDER.

Makes it a Class C felony to fail to obey a law enforcement officer's direction to stop a motor vehicle, resulting in serious bodily injury or death to another person.

RELATING TO VEHICLES.

Amends the scope of offenses relating to negligent injury by broadening the offenses' application to include negligent injuries caused by mopeds and vessels.

RELATING TO ALL-TERRAIN VEHICLES.

Prohibits minors from using all-terrain vehicles.  Prohibits the use of all-terrain vehicles on public roadways.  Prohibits passengers from riding on all-terrain vehicles.  Prohibits the use of all-terrain vehicles between sunset and sunrise.  Prohibits the use of all-terrain vehicles without a helmet.

Status

RELATING TO MOPEDS.

Allows for mopeds designed to carry both a passenger and driver to be used on a public street.

Status

RELATING TO MOPEDS.

Prohibits persons driving a moped from carrying any package, bundle, or other article which prevents the person from keeping both hands on the handlebars.  Prohibits the operation of a moped with handlebars more than fifteen inches in height above that portion of the seat occupied by the driver.  Prohibits the driver of a moped from overtaking and passing in the same lane occupied by the vehicle being overtaken.  Prohibits the operation of a moped between lanes of traffic or between adjacent lines or rows of vehicles.

Requires passengers on a three-wheeled moped to be at least sixteen years of age.

Status

RELATING TO SAFE ROUTES TO SCHOOL.

Permanently establishes the Safe Routes to School Program within the Department of Transportation.  Establishes a Safe Routes to School Special Fund.  Assesses a surcharge of $25 for violations of speeding in a school zone and a $10 surcharge on various traffic violations and deposits these surcharges into the Safe Routes to School Special Fund.  Deposits federal Safe Routes to School Program moneys into the Safe Routes to School Special Fund.  Effective July 1, 2012.

Status

RELATING TO MOTOR VEHICLES.

Prohibits text messaging while operating a motor vehicle.  Imposes penalty of not more than $100 for each violation.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
