Status

RELATING TO THE COMMERCIAL HARBORS.

Amends chapter 266, Hawaii Revised Statutes, to clarify that persons cited for non-criminal violations are subject to administrative appeal and the not District Court; clarifies that enforcement agents such as the harbor master, harbor agents, facility security officer, or district manager can issue citations for non-criminal violations; provides that penalties and fines are deposited into the Harbor Special Fund; allows Department of Transportation to seek reimbursement from tenants or harbor users that violate security rules in harbor secured areas thereby causes a fine or penalty from the U.S. Coast Guard upon the Department of Transportation.

 

The issuance of citations for traffic code violations and other criminal statutes are restricted to law enforcement officers and fines and penalties remain in the jurisdiction of the District Courts.

RELATING TO SPECIAL MANAGEMENT AREA USE PERMITS.

Adds an exception to the Special Management Area Use permit requirement for development by excluding airports pursuant to chapter 261 when complying with Federal Aviation Administration regulations.

RELATING TO AIRPORT REVENUE.

Amends Sections 261-7 and 171-59 Hawaii Revised Statutes to provide more flexibility in renting land and facilities at airports for revenue generation purposes.

RELATING TO HIGHWAY SAFETY.

Clarifies recommendations of the ignition interlock implementation task force.  Allows for renewal of a driver's license revoked for impaired driving.  Allows repeat intoxicated drivers to install ignition interlock devices in any vehicle they operate, by eliminating the requirement to surrender motor vehicle registrations and license plates.  Provides guidelines for ignition interlock instruction permits and ignition interlock permits.  Makes housekeeping amendments to chapter 291E.

RELATING TO ELECTRIC VEHICLES.

Codifies Act 290, Session laws of Hawaii 1997, requirement for the Department of Transportation to adopt rules for the registration of, and issuance of license plates for, electric vehicles and revises and codifies electric vehicle exemptions from parking fees and High Occupancy Vehicle lane restrictions.

RELATING TO DRIVER LICENSING.

Directs the Director of the Department of Transportation to select a statewide driver's license reciprocity committee to evaluate foreign countries' requests for driver's license reciprocity to ensure the standards of the foreign countries' driver's license testing is equivalent to Hawaii's driver's license testing.

Status

RELATING TO THE TAX LIEN AND ENCUMBRANCE RECORD.

Amends section 286-46, Hawaii Revised Statutes, to allow the recordation of outstanding judgments payable to state or county agencies as a condition precedent to the vehicle's renewal, registration, or transfer of ownership, and to exempt state or county agencies from paying the statutory fee of $5.

RELATING TO MOTOR VEHICLE INSURANCE.

Effective 1/1/14, requires motor vehicle insurers to electronically report to the insurance commissioner all existing policies within 45 days.  Requires each insurer to report cancelled, nonrenewed, altered, and new policies.

RELATING TO TORT LIABILITY.

Clarifies the definition of "similar circumstances" concerning joint liability in certain motor vehicle accidents.

Status

RELATING TO SPECIAL WASTES DISPOSAL AND RECYCLING.

Requires a deposit for each new motor vehicle tire sold that is not exchanged with a used motor vehicle tire, to be refunded on exchange of a used motor vehicle tire.  Does not apply to motorcycle or bicycle tires.

Status

RELATING TO ETHANOL.

Repeals the ten per cent ethanol by volume requirement for gasoline sold in Hawaii for use in motor vehicles.  Requires the Hawaii state energy office to submit reports on local ethanol production.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
