RELATING TO THE COMMERCIAL HARBORS. Amends chapter 266, HRS, to clarify that persons cited for non-criminal violations may appeal through an administrative hearing; clarifies that enforcement agents such as the harbor master, harbor agents, facility security officer, or district manager can issue citations for non-criminal violations; provides that penalties and fines are deposited into the harbor special fund; allows the DOT to seek reimbursement from tenants or harbor users that violate security rules in harbor-secured areas. The issuance of citations for traffic code violations and other criminal statutes are restricted to law enforcement officers and fines and penalties remain in the jurisdiction of the District Courts. Broadens the definition of law enforcement officer to include any employee, officer, or representative of DOT conferred by the director with police powers. (SD2)

RELATING TO THE TAX LIEN AND ENCUMBRANCE RECORD. Allows the recordation of outstanding judgments payable to state or county agencies as a condition precedent to a vehicle's renewal, registration, or transfer of ownership. Exempts state and county agencies from paying the tax lien and encumbrance record statutory fee if state and county agencies to provide to the director of finance the license plate number or vehicle identification number. Allows taxpayer to enter into agreement with the department of taxation to pay the delinquent taxes in lieu of full payment to avoid recordation of a tax lien and encumbrance record. (SD1)

RELATING TO AIRPORT REVENUE. Provides more flexibility to the department of transportation in renting land and facilities at airports for revenue generation purposes. (SD1)

RELATING TO PERSONAL INFORMATION. Allows the scanning and retention of personal information contained in a Hawaii identification card or driver's license by certain specified entities for limited purposes. (SD2)

RELATING TO ENVIRONMENTAL IMPACT STATEMENTS. Authorizes agencies to exempt certain secondary actions from the environmental impact statements law. Requires that applicants proposing certain actions identified in the environmental impact statements law prepare environmental assessments. Requires the office of environmental quality control to determine whether preparation of an environmental assessment by an applicant is required in cases where it is uncertain which agency has the responsibility of determining whether an environmental assessment is required. RELATING TO ELECTRIC VEHICLES. Codifies certain provisions of Act 290, Session laws of Hawaii 1997, and repeals the rest. Authorizes the department of transportation to adopt rules for the registration of, and issuance of license plates for electric vehicles. Exempts electric vehicles from parking fees under certain conditions. Effective 1/1/2013. (SD1)

RELATING TO ELECTRIC VEHICLE PARKING. Requires that owners or managers of places of public accommodation with at least one hundred parking spaces available for use by the general public to designate at least one percent of parking spaces or up to five parking spaces, whichever is lesser, exclusively for electric vehicles by July 1, 2012. Requires that at least one parking space is equipped with an electric vehicle charging system. Prohibits any parking space designated for electric vehicles to displace or reduce accessible stalls called for by the Americans with Disabilities Act Accessibility Guidelines. Requires issuance of a warning for parking a non-electric vehicle in a stall for electric vehicles beginning 1/1/2013. (SD1)

RELATING TO LIGHT POLLUTION. Requires every new and replacement outdoor light fixture to be fully shielded beginning 7/1/13, with certain exemptions. (SD1)

RELATING TO ETHANOL. Repeals the requirement that gasoline contain 10% ethanol. Takes effect on 7/1/2050. (SD1)

RELATING TO MOTOR VEHICLE INSURANCE. Allows motor vehicle insurers to offer insurance premium discounts for completion of a driver safety course or driver improvement course. (SD2)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
