RELATING TO TRANSPORTATION. Reduces remittance of rental vehicle surcharge to the general fund from $4.50 to $3.50. Extends sunset date for Act 104, sections 4 and 5, SLH 2011, from 2012 to 2017.

RELATING TO THE MOTOR VEHICLE RENTAL INDUSTRY. Provides that lessors may pass on vehicle title, plate, registration, and inspection costs to lessees.

RELATING TO MOTOR VEHICLE INSURANCE. Makes prepaid motor vehicle insurance policies nonrefundable except in the cases of total loss, change in policy, sale of vehicle, or transportation of vehicle out-of-state. Imposes burden on insured to prove one of the exceptions.

RELATING TO COMMERCIAL DRIVER'S LICENSE. Prohibits driving a commercial motor vehicle without a commercial driver's license in the driver's possession; and prohibits texting while operating a commercial motor vehicle.

RELATING TO MOTOR VEHICLES. Prohibits text messaging while operating a motor vehicle. Imposes penalty of not more than $100 for each violation.

RELATING TO HOMICIDE. Amends the driver's license revocation provisions to allow license revocation for a period of time up to the maximum term of probation allowable when a driver is convicted of manslaughter resulting from the operation of a vehicle, or negligent homicide in the first or second degrees; allows for up to two years of imprisonment when a convicted defendant is sentenced to probation for manslaughter; and clarifies that probation is an applicable sentence for manslaughter.

RELATING TO HOMICIDE. Requires drivers' license revocations upon convictions for negligent homicide in either the first or second degree. Sets maximum periods of license revocations for convictions of manslaughter and negligent homicide in the first or second degree. Makes imprisonment of up to two years a discretionary condition of probation for manslaughter convictions. Clarifies that probation is an available sentence for manslaughter.

RELATING TO PERSONAL INFORMATION. Prohibits the scanning and retention of personally identifiable information stored in the machine-readable zone of the Hawaii driver's license and identification card without the express consent of the holder of the driver's license or identification card unless the use is by law-enforcement officers for solely official purposes.

RELATING TO TESTING FOR INTOXICANTS. Repeals section 291E-68, Hawaii Revised Statutes, regarding refusing to submit to a breath, blood, or urine test for those arrested for the use of intoxicants while operating a vehicle. Makes conforming amendments to section 291E-15, Hawaii Revised Statutes.

RELATING TO PERSONAL INFORMATION. Allows the scanning and retention of personal information contained in a state identification card or driver's license for only limited purposes.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
