RELATING TO TRANSPORTATION. Makes an appropriation from the Harbor Special Fund and Airports Revenue Fund for the Department of Transportation to hire a consultant to conduct a study on enhancing security technology at Hawaii's harbors and airports. Effective July 1, 2012.

RELATING TO TRANSPORTATION. Authorizes the Department of Transportation to extend the term of an airport concession, and to modify and amend the terms of any concession lease or contract in exchange for revenue-enhancing improvements that are made or paid for by the concession. Effective July 1, 2012.

RELATING TO TOLL ROADS. Authorizes director of transportation to impose toll charges on existing highways or construct new toll roads. Provides for agreement with private entities to construct, operate, and maintain toll roads. Requires prior feasibility study.

RELATING TO CIVIL IDENTIFICATION. To make the Director of Transportation responsible for the non-driver's identification card program for the State of Hawaii and to have the non-drivers' identification cards issued by the examiners of drivers in each county to comply with the federal REAL ID Act of 2005, division B of Public Law No. 109-13, by January 15, 2013.

RELATING TO TRAFFIC VIOLATION RECORDS. Beginning on December 1, 2012, requires the removal of certain certified traffic abstracts records of all alleged moving violations for which the disposition of the case was "dismissed with prejudice" or "not guilty", or that occurred more than ten years prior to the date of the request for the abstract, with exceptions.

RELATING TO FUNDING FOR PARKING FOR DISABLED PERSONS. Increases the state vehicle registration fee by $1, to be deposited into the Disability and Communication Access Board Special Fund to cover the costs of administering the parking program for persons with disabilities.

RELATING TO THE ZIPPER LANE. Requires the Department of Transportation to conduct a feasibility study on the extension of the zipper lane westward from Waipahu toward Kapolei, west of the Kunia on-ramp. Appropriates funds for the study. Effective July 1, 2012.

RELATING TO SAFE ROUTES TO SCHOOL. Permanently establishes the Safe Routes to School Program within the Department of Transportation. Establishes a Safe Routes to School Special Fund. Assesses a surcharge of $25 for violations of speeding in a school zone and a $10 surcharge on various traffic violations and deposits these surcharges into the Safe Routes to School Special Fund. Deposits federal Safe Routes to School Program moneys into the Safe Routes to School Special Fund. Effective July 1, 2012.

RELATING TO PENALTIES. Establishes a penalty for persons who violate the bumper height requirements of Section 291-35.1, Hawaii Revised Statutes.

RELATING TO HIGHWAY SAFETY. Prohibits the use of modified air compression braking systems on passenger cars.

RELATING TO TRAFFIC SAFETY. Provides that violations for speeding in construction areas are only applicable when construction is actively occurring in the construction area.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
