Makes a grant-in-aid to the county of Hawaii office of prosecuting attorney for career criminal prosecution program.

MAKING A GRANT-IN-AID FOR THE DEPARTMENT OF THE PROSECUTING ATTORNEY OF THE COUNTY OF MAUI.

Makes a grant-in-aid for the department of the prosecuting attorney of the county of Maui for the career criminal prosecution program.

      Status & Testimony

RELATING TO COUNTY ADMINISTRATIVE PROCEDURES.

Exempts from the administrative procedures act the requirement that the adoption, amendment, or repeal of any rule by any county agency shall be subject to the approval of the county mayor.  Provides rule-making authority to the county semi-autonomous public transit agencies, including the Honolulu authority for rapid transportation.

RELATING TO TAXATION.

Authorizes each county to establish a retail sales tax of up to two per cent on sales of tangible personal property from a retailer to a consumer; requires the retail sales tax to take effect two years after the date of the adoption of the tax in that county.

RELATING TO PUBLIC CONTRACTS.

Requires government contractors to disclose to the public certain specified information concerning the contract upon request pursuant to the uniform information practices act.

RELATING TO THE STATE PROCUREMENT CODE.

Makes permanent the amendments made to section 103D-305, Hawaii Revised Statutes, by Act 175, Session Laws of Hawaii 2009, that increase the limits on procurements qualifying for certain small purchase procedures to $100,000 for goods or services and $250,000 for construction; require procurements greater than $50,000 for construction to require performance bonds, and require procurements of $25,000 to less than $100,000 to be made in accordance with small purchase procedures.  Removes the requirement from section 103D-305 that procurements of $25,000 to less than $100,000 be done through an electronic system.

RELATING TO PROCUREMENT.

Allows a bidder 2 additional days after the bid submission closing date to submit names of joint contractors or subcontractors.  Requires the opening of bids at the close of the 2-day period.

RELATING TO PROCUREMENT.

Requires solicitations for procurement of construction to require offerors to list subcontractors if the value of the contract is in excess of $500,000 and the work to be performed by the subcontractor is in excess of $25,000.  Allows substitution of subcontractors if 75% of saving resulting from the substitution are refunded to the purchasing agency.

RELATING TO CAMPAIGNS.

Clarifies that public contractors are prohibited from making a campaign contribution during the duration of the contract by requiring all public contractors to explicitly agree through a provision in their public contracts to be subject to the prohibition and penalties for any violations.

RELATING TO E-VERIFY.

Requires purchasing agencies that entering in to any procurement contract to obtain proof that the responsible bidder or offeror uses the e-verify system to verify employment eligibility.

RELATING TO THE COLLECTION OF DEMOGRAPHIC DATA BY STATE AGENCIES, BOARDS, AND COMMISSIONS.

Requires state agencies to disaggregate data consistent with federal standards and requires publication of the data.

MAKING AN EMERGENCY APPROPRIATION FOR REIMBURSEMENT OF COSTS RELATED TO THE ASIA-PACIFIC ECONOMIC COOPERATION MEETINGS.

Provides reimbursements of funds to the seven departments that incurred costs for planning, safety, and security necessary for the Asia-Pacific Economic Cooperation meetings held in November 2011.

RELATING TO OFFENSES AGAINST PUBLIC ADMINISTRATION.

Creates the offense of disrespect of a house of the legislature for disorderly or contemptuous behavior by a person who is not a member of the legislature.
