RELATING TO WORKERS' COMPENSATION. Increases the fee schedule of compensation for medical care, services, and supplies in workers' compensation cases from 110 percent to 130 percent of the Medicare Resource Based Relative Value Scale applicable to Hawaii as prepared by the United States Department of Health and Human Services.

RELATING TO STATE EMPLOYMENT. Clarifies exemptions from civil service for federally funded work experience programs and temporary public service employment; allows persons with criminal conviction to participate in such programs provided reasonable safeguards are in place.

RELATING TO APPRENTICESHIP. Amends the state apprenticeship law to conform to new federal regulations on apprenticeship in 29 Code of Federal Regulations part 29.

RELATING TO EMPLOYMENT SECURITY LAW. Amends the procedure for rate determination to clarify that the department's determination must be appealed to the referee and not directly to circuit court.

RELATING TO WAGES. Clarifies the definition of "wages" in the Payment of Wages and Other Compensation Law, chapter 388, Hawaii Revised Statutes, to include any promised paid time off.

RELATING TO THE ADVISORY COUNCIL FOR COMMUNITY SERVICES. Abolishes the Advisory Council for Community Services.

RELATING TO APPEALS TO THE APPELLATE BOARD. Authorizes the Labor and Industrial Relations Appeals Board to establish reasonable fees for the filing of appeals and other administrative costs associated with the processing of appeals and to establish a Labor and Industrial Relations Appeals Board Special Fund.

RELATING TO DISABILITY COMPENSATION DIVISION SPECIAL FUND. Authorizes the Disability Compensation Division to establish a Disability Compensation Division Special Fund and to establish reasonable fees for the issuing of subpoenas and filing of first injury reports.

RELATING TO LABOR. Directs the DLIR to establish a state-funded training program to expand the workforce investment activities administered by the DLIR under the federal Workforce Investment Act. Makes an appropriation.

RELATING TO A LIVING WAGE FOR WORKERS ON SERVICE CONTRACTS. Requires contractors with public contracts greater than $5,000: (1) to pay their employees wages that provide an annual income equal to the poverty guidelines for Hawaii published by the federal DHHS, or a greater amount; and (2) to allow their employees to have access to and join labor organizations.

DECISION MAKING TO FOLLOW

· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
