RELATING TO NOTICE OF WORKERS’ COMPENSATION INSURANCE.

To allow the Director of Labor and Industrial Relations to accept the notice of employer's workers' compensation insurance from approved third party agencies in a manner and form approved by the director.

RELATING TO UNEMPLOYMENT INSURANCE INTEREST PAYMENT.

Authorizes the Department of Labor and Industrial Relations director to increase the employment and training assessment in increments of .01 per cent retroactive to January 1, 2012, for payment of interest on federal loans for unemployment insurance benefits.

RELATING TO THE WEED AND SEED PROGRAM.

Establishes the weed and seed program under the department of labor and industrial relations.  Makes appropriation.

RELATING TO HEALTH.

Requires employers to provide a minimum amount of paid sick and safe leave to employees to be used to care for themselves or a family member who is ill, needs medical care, or is a victim of domestic violence, sexual assault, or stalking.

RELATING TO WORKERS' COMPENSATION.

Clarifies that attorney's fees may be included in costs that may be assessed against a party who brings, prosecutes, or defends a workers' compensation claim without reasonable ground.

RELATING TO EMPLOYMENT VACANCIES.

Requires State agencies to fill job positions within ten years after a vacancy; requires the automatic removal of funds for positions vacant longer than ten years.

Status

RELATING TO BREASTFEEDING IN THE WORKPLACE.

Requires an employer with twenty or more employees to make reasonable efforts to provide a clean location for breastfeeding employees to express breast milk in privacy.  Requires covered employers to post a notice pertaining to this provision in a conspicuous location.  Establishes a civil fine for the failure of an employer to provide a location or post notice.

Status

RELATING TO EMPLOYMENT SECURITY.

Sets the unemployment insurance contribution rate schedule at "schedule F" for calendar years 2012 and 2013.  Retains the maximum weekly benefit rate for unemployment at 75% of the average weekly wage until 12/31/13, and returns the rate to 70% on 01/01/14.  Increases the maximum contribution rate, effective 1/1/13.

RELATING TO INFORMATION FOR TEMPORARY DISABILITY INSURANCE CLAIMS.

Establishes a deadline for an employer to submit the Employer's Statement portion of a Temporary Disability Insurance claim form when requested by an employee.

Status

RELATING TO MEDICAL BENEFITS UNDER THE WORKERS’ COMPENSATION LAW.

Amends section 386-21(c), Hawaii Revised Statutes, by requiring the Director of Labor and Industrial Relations to make a decision on disputes regarding treatment plans and continued medical services without a hearing.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:

·     Testifier's name with position/title and organization;

·     The Committee the comments are directed to;

·     The date and time of the hearing;

·     Measure number; and

·     The number of copies the Committee is requesting. 

 

While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
