PROPOSING AN AMENDMENT TO ARTICLE VI, SECTION 3, OF THE CONSTITUTION OF THE STATE OF HAWAII AUTHORIZING THE CHIEF JUSTICE OF THE STATE SUPREME COURT TO APPOINT RETIRED JUDGES TO SERVE AS EMERITUS JUDGES. Proposes a constitutional amendment authorizing the chief justice of the supreme court to appoint judges who have retired upon attaining the age of seventy years as emeritus judges, permitting the appointed judges to serve as per diem judges or judicial mentors in courts no higher than the court level they reached prior to retirement and for terms not to exceed three months.

PROPOSING AN AMENDMENT TO ARTICLE V, SECTION 6, OF THE HAWAII STATE CONSTITUTION, TO PROVIDE FOR THE ELECTION OF THE ATTORNEY GENERAL. Proposes amendment to article V, section 6, of the state constitution to provide that the attorney general be elected as a nonpartisan elected official rather than appointed by the governor. (SD1)

RELATING TO THE PENAL CODE. Requires probation officer, prior to early discharge of defendant, to report to court concerning defendant’s compliance or non‑compliance with terms of probation.

RELATING TO BAIL. Requires law enforcement agencies to accept cash bail, certified copies of pre-filed bail bonds, and original bail bonds when the court is closed, including nights, weekends, and holidays. Specifies from whom bail may be accepted. Requires prompt release after acceptance of bail.

RELATING TO BAIL BONDS. Enacts provisions regulating the procedures and rights of bail bondsmen in bail forfeiture cases. Effective 07/01/50. (SD1)

RELATING TO POST CONVICTION PROCEEDINGS. Establishes time limits for filing habeas corpus complaints and limits successive complaints. Provides and exemption from the time limits for any motion, petition, or appeal filed pursuant to part XI, of chapter 844D, Hawaii Revised Statutes. Effective 07/01/50. (SD1)

RELATING TO PUBLIC SAFETY. Provides an exemption to electronic communication service providers to divulge the contents of the communication information to law enforcement agencies, public safety agencies, and public safety answering points under certain circumstances. (SD2)

RELATING TO ANIMAL CRUELTY. Requires dogs or cats that are captured or killed in a snare or trap to be reported to a county animal control officer. Establishes an animal cruelty offense for the use of steel-jawed leg-hold traps, and the use of snares, conibear, and foot- or leg-hold traps in residential or other prohibited areas; provides exemptions for activities carried out by state and federal agencies; establishes the offense as a misdemeanor. RELATING TO ANIMAL CRUELTY. Extends procedures for impoundment and forfeiture for cruelty to animal offense to equine animals to the same extent as pet animals. Effective 07/01/50. (SD1)

RELATING TO ANIMAL CRUELTY. Requires specified persons who own, control, or have custody or control of ten or more dogs over age four months with intact sexual organs to meet minimum standards of care to ensure the proper treatment and care of dogs and the dogs' offspring. Prohibits any person from owning or having custody of more than thirty dogs over age of one year with intact sexual organs. Requires specified persons to maintain specific records for each dog for at least three years following the death of the dog or a date on which the person permanently ceased to have possession or control of the dog. Prohibits certain types of dogs in the same enclosure. Establishes penalties. Effective 07/01/50. (SD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
