RELATING TO APPROPRIATIONS TO THE DEPARTMENT OF THE PROSECUTING ATTORNEY OF THE CITY AND COUNTY OF HONOLULU. Appropriates funds to the department of the prosecuting attorney of the city and county of Honolulu for career criminal prosecution unit, prosecution in drug court, prosecution in Hawaii's opportunity probation with enforcement, and victim witness assistance program.

MAKING AN APPROPRIATION TO THE DEPARTMENT OF THE PROSECUTING ATTORNEY OF THE COUNTY OF MAUI. Appropriates funds to the Department of the Prosecuting Attorney of the County of Maui for the career criminal prosecution program. Effective July 1, 2012.

RELATING TO INNOCENCE REDRESS. Provides compensation and services to persons who can demonstrate they were wrongfully convicted of a crime and imprisoned.

RELATING TO DEBT COLLECTION. Provides that the Attorney General shall collect accounts delinquent for more than 90 days for executive departments, excepting the University of Hawaii. Creates a fund into which an unspecified percent of any money recovered by the Attorney General will be deposited, while the remainder will be returned to the department from which it came. Allows the Attorney General to list and eliminate uncollectable accounts based upon certain criteria.

RELATING TO THE INFORMATION PRIVACY AND SECURITY COUNCIL. Allows the Comptroller to designate a replacement to serve and chair the Information Privacy and Security Council.

RELATING TO THE STATE CODE OF ETHICS. Excepts members of groups convened solely to provide comments, share technical knowledge or expertise, or assist in formulating recommendations to, with or for the Legislature, Governor, or other state departments, agencies, or boards, from chapter 84, Hawaii Revised Statutes, State Ethics Code.

RELATING TO LIMITED EXEMPTION UNDER STATE ETHICS CODE REGARDING CHARITABLE EVENTS. Exempts from restrictions on gifts under the ethics code invitations or complimentary tickets to a widely attended charitable event from a charitable entity, whether or not the charitable entity is the host of the charitable event. Requires disclosure. Effective July 1, 2012.

RELATING TO CAMPAIGN SPENDING. Requires the Campaign Spending Commission to maintain public records in a searchable database. Amends reporting requirements by, amongst other things, requiring corporations and noncandidate committees to disclose the name of a candidate identified in any advertisement or electioneering communication which they have funded directly or indirectly. Penalizes all persons failing to report to the Commission. Mandates that the Commission implement rules for campaign spending consistent with Hawaii Revised Statutes within 360 days of the effective date of this Act.

RELATING TO CAMPAIGN SPENDING. Repeals current reporting provisions for corporations. Establishes requirements for persons other than individuals, candidates, candidate committees, and noncandidate committees to register with the Campaign Spending Commission and file reports. Allows the Campaign Spending Commission to monitor and penalize persons for absent or deficient filings. Requires more detail in reporting for all persons, especially regarding contributions or expenditures for advertisements or electioneering communications.

RELATING TO CAMPAIGN SPENDING. Amends public funding pilot project for county of Hawaii county council elections to raise the program cap, repeal the requirement of a minimum fund amount, extend the period for signature collection, clarify provision of matching funds, and to clarify that the formula to determine the amount of funds given to a publicly funded candidate is based on the prior two general elections actually held for the county council seat in that district.

RELATING TO TRANSPORTATION. Allows the court to require the immobilization of a motor vehicle owned by an individual convicted of driving without a license or driving with a canceled, suspended, or revoked license or a vehicle owned by an individual who is not in compliance with an order of paternity or child support by means of a wheel immobilization device for a period not to exceed 180 days. Requires the surrender of number plates. Provides for the removal of wheel immobilization device and return of number plates after the court ordered immobilization period is completed.

RELATING TO TRAFFIC INFRACTIONS. Requires the state director of finance to transmit to each county a percentage of all fines and forfeitures collected for uncontested traffic infractions committed in that county, with certain exceptions. Effective January 1, 2013. (HB1749 HD1)

RELATING TO DRIVER LICENSING. Increases the gross vehicle weight rating of category (3) motor vehicle driver licenses to eighteen thousand pounds or less.

RELATING TO EVIDENCE. Amends the title of Act 210, Session Laws of Hawaii 2008, to read news and broadcast media privilege. Expands the application of the Act to expressly include bona fide owners or editors of news or broadcast media entities. Clarifies that, where applicable, the news and broadcast media privilege will shield a journalist, newscaster, owner, or editor of a news or broadcast media entity from being compelled to testify or produce the source of information whether or not it has been published or broadcasted, or any unpublished or unbroadcasted information.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
