RELATING TO TEMPORARY RESTRAINING ORDERS.

Adds a mandatory prison term of fifteen days and a fine of not less than $150 nor more than $600 for a person with certain prior convictions who is convicted for the first time for violation of a temporary restraining order.  Effective January 7, 2059.  (HB238 HD2)

RELATING TO WITNESSES.

Increases the per diem payments for out-of-state witnesses in criminal cases from $110 to $145.  Provides an additional $90 per diem payment for witnesses from any island other than the island on which the court is located, when that witness is required to stay overnight.  Effective January 7, 2050.  (HB245 HD1)

RELATING TO FELONIES FOR WHICH CRIMINAL CHARGES MAY BE INSTITUTED BY WRITTEN INFORMATION.

Amends section 806-83, HRS, to add felonies for which criminal charges may be instituted by written information (section 708-803 (habitual property crime), section 708-    (unauthorized entry in a dwelling in the first degree), section 708-812.6 (unauthorized entry in a dwelling in the second degree), and section 708-835.7 (theft of copper)).

RELATING TO ACCUSED TO TRANSPORT WITNESS OR WITNESSES.

Adds a new section to chapter 571, HRS, to allow  family courts   to require the accused to transport a witness or witnesses, including a complaining witness or witnesses, to any court proceeding under certain conditions.

RELATING TO CRIMINAL PROCEDURE.

Codifies dismissals pursuant to Rule 48, Hawaii rules of penal procedure.  Exempts cases for abuse of family or household members charges from the dismissal rule.

RELATING TO USE OF FORCE BY PERSONS WITH SPECIAL RESPONSIBILITY FOR CARE, DISCIPLINE, OR SAFETY OF OTHERS.

Establishes types of physical force not justifiable when used to discipline minors.

      Status & Testimony

RELATING TO APPROPRIATIONS TO THE DEPARTMENT OF THE PROSECUTING ATTORNEY OF THE CITY AND COUNTY OF HONOLULU.

Appropriates funds to the department of the prosecuting attorney of the city and county of Honolulu for career criminal prosecution unit, prosecution in drug court, prosecution in Hawaii's opportunity probation with enforcement, and victim witness assistance program.
