      Status & Testimony

RELATING TO THE BOILER AND ELEVATOR SAFETY LAW.

Establishes the boiler and elevator special fund to collect and deposit fees for inspections, permits, and examinations of boilers, pressure systems, elevators, and kindred equipment; provides for sufficient operating costs to carry out the purpose of the boiler and elevator safety law.  Authorizes the director of labor and industrial relations to establish up to ten additional positions, including elevator and boiler inspectors.  Appropriates funds for start up costs and hiring of necessary staff.

Increases minimum wage to $7.75 for 2012 and $8.25 from 07/01/2013.  Effective 07/01/2012.

Increases the fee schedule of compensation for medical care, services, and supplies in workers' compensation cases from 110 percent to 130 percent of the Medicare Resource Based Relative Value Scale applicable to Hawaii as prepared by the United States Department of Health and Human Services.

Requires an appointing authority to consider another position within the same department for which an employee is qualified before the employee is considered for discharge due to failure to meet performance requirements.

RELATING TO COLLECTIVE BARGAINING.

Clarifies provisions that negotiations relating to contributions to the Hawaii employer-union health benefits trust fund shall be to agree upon amounts that the State and counties shall contribute toward the payment of costs for a health benefits plan and group life insurance benefits for certain groups; clarifies that a decision of an arbitration panel shall be final.
